A State Supreme Court justice’s decision to acquit three police detectives in the November 2006 death of an unarmed man was stunning in its thorough absolution of the officers who fired 50 bullets at Sean Bell and two companions as they sat in a car outside a strip club.


Justice Arthur Cooperman found the three — even one officer who reloaded his gun to squeeze off 31 rounds — not guilty of all charges of manslaughter, assault and reckless endangerment.

As all New Yorkers should, we respect Justice Cooperman’s verdict, but we do not believe all questions of accountability were resolved. Mr. Bell’s family has said it plans to pursue a civil lawsuit, and federal prosecutors are examining the case. We hope they bring answers.

Large questions remain about the New York Police Department. In recent years, when police have killed unarmed men, they have been, almost without exception, black. The detectives on trial said that they believed Mr. Bell, Joseph Guzman and Trent Benefield had a gun, and based on that suspicion they fired away. No gun was found. Similarly, in 1999 police fired 41 bullets at Amadou Diallo, an unarmed African immigrant who was just reaching for his wallet. The acquittal of four police officers after that killing, which occurred during the racially challenged leadership of Mayor Rudolph Giuliani, set off unrest in which scores were arrested.

Anger and disappointment are understandable now, but New York’s leadership has changed, and community activists need to absorb that fact before they attempt to heat up reaction. Mayor Michael Bloomberg and Police Commissioner Ray Kelly are trying to correct the conditions that led to the Bell shooting, changes that take time and good faith on all sides. Both men have kept a schedule of outreach to minority communities.

Progress has been steady. After the Bell shooting, Mr. Kelly ordered an independent study of department firearms training by the Rand Corporation. The results should be available soon. The commissioner hopes to prevent “reflexive shooting” after one officer fires an initial shot. Detective Michael Oliver alone managed to fire 31 of the 50 rounds toward Mr. Bell’s car — all in the few seconds following an initial shot from Gescard Isnora.

The commissioner is also reforming undercover operations, including requiring breathalyzer tests after an officer fires a weapon. In the Bell shooting, undercover officers said that they stayed within the allowed limit of two alcoholic beverages, but they were not tested.

The margin of error once shooting begins has become distressingly small. The police have come to favor fast, easy-to-fire weapons like 9-millimeter semiautomatics. The rule that an officer is to pause and reassess after three shots can be forgotten in the heat of gunplay.

We also wonder why the police continue to put themselves and others in harm’s way with undercover operations at places like strip clubs. The club where Mr. Bell spent the night before his scheduled wedding was reputed to be a haven for prostitutes, drug dealers and gun traders. We suspect that it and others like it have health- or fire-code violations that could shut them, without deadly risk.

In his verdict, Justice Cooperman indicated that he found no carelessness or incompetence that rose “to the level of criminal acts.” We respect that judgment as a matter of law, but we see both carelessness and incompetence in the behavior of the police officers that must be corrected as a matter of public policy.

I was under the impression that it was one of the minority officers that reloaded and I also read somwhere there are two others involved in this. Any truth to that

racism does exist in the US, but it is on the wane. The link i placed from BA in another article clearly indicated that racial slurs are more common from the older generation who grew up in a more racist environment.
most of the current crop of white youths grew up idolizing black athletes like Michael Jordan, Black musicians like Kanye West and Puffy. They've come up in a world where the Black man has increased profile.
Check Obama's progress for example. Do you know what segment constitutes a large segment of his voting bloc? The young college and university students!

The cops in this case were clearly not driven by racism. however i feel that racial stereotyping may have been at play in the initial suspicion of the Bell entourage. There's some form of stereotyping in suspecting a group of black guys stumbling out from the strip club as being up to no good.

It might be worthwile to remember that the Judge acquitted the cops of criminal wrongdoing. The cops most likely panicked and may have been too hasty and too reckless in opening fire (due to panic), but there was no indication that they did so with any criminal (read: murder) intent. The possibility of a civil suit is still open, and i fully expect the Bell family to Sue the NYPD and get a decent compensation AND an apology. An unarmed man is dead, and someone has to pay for it. Unlike you, however, i'm not baying for blood.

I am a Nigerian and I do not believe he insulted me or my intelligence. Infact, I believe it is people who continue to try all they can to stick to what many have come to consider the ONLY justifiable way of looking at these things, that continue to "fi owo osi juwe ile baba wa". Those minds are the reason we do not command respect in the world we live in today. Those minds have lead us dig the whole deeper and deeper for us without considering that maybe a change of approach and a change of vision is necessarily for us to not only regain the respect that was once ours in the world scene but also rise to the top 10 in world scene.

What good is old age to an old man when he has yet to learn the very real lessons of life but continue to dwell on the mistakes of the bitter past and use that to decide his present?? Do you really think that is what Nigeria or the black community needs

I think you get it all twisted and wrong. People who are racist are the ones who continually try to deal with the other race as one they need to put down at any opportunity they get. If you look at the way things are in the world today, better yet, let me use America as an example for you. The races that have moved past the race issue happen to thrive more than the races that continue to feel race should be a big issue on a daily basis. It is not that mexicans or chinese or indians or even caucasians do not have to deal with racism as it does exist. It is they have mostly come to understand that it is not really something they can legislate away but something they can rise above and stop making a huge issue of. And the more they have done that, the more it seems they have not only gained respect for themselves among other races but have thrived. After reading your extremely childish rant, It all becomes clear to me. you ARE a child. Seeing as my youngest sibling (23 years) can easily make a FAR more mature and intelligent argument than you can, i doubt you're as old as you claim to be.

But all that is immaterial. Young or old, you've demonstrated you're an idiot. There are lots of problems holding Nigeria back, and to fix them we need all the smart people we can get. You don't qualify.

God bless America.  The reason I can never argue with a police man in Nigeria not to talk of America.  You will die for nothing and the police will go scott free.

There is a limit to how much[b] freedom [/b] your life can buy.

After all the protests, nothing will come out of it. Like the Rodney King saga. We know who owns America. Some of us are just guests with a "renewable"visa to live.
