I Won't Go On Terminal Leave - Prof. Jega by eye4eye: 1:29am On Feb 11, 2015
The Chairman of the Independent National Electoral Commission, Prof. Attahiru Jega, has said he does not have any plan to embark on terminal leave.

This was contrary to unsubstantiated report that Jega would proceed on a forced terminal leave on March 1.

But Jega’s Chief Press Secretary, Mr. Kayode Idowu, denied this saying his boss was busy preparing for the conduct of the elections.

He said, “Jega is busy preparing for the elections and you are asking about terminal leave. Does anyone planning to conduct elections go on terminal leave? There is nothing like that.”

Idowu had in an interview on a TV programme monitored in Lagos, on Tuesday, said Jega’s appointment was not guided by civil service rules and would serve until the end of his tenure on June 30.

He said the postponement of the elections would make INEC better prepared for the elections scheduled for March 28 and April 11.

Idowu also denied the report that Jega had resigned his appointment due to pressure from the Presidency.

Idowu said, “No, that’s (resignation) is not true, he has not resigned. He didn’t resign. It is a mere rumour.”

Similarly, the minority leader of the House of Representatives, Mr. Femi Gbajabiamila, said Jega could not be asked to go on a terminal leave because he was not a civil servant.

He said, “I do not consider the Chairman of INEC as a civil servant subject to civil service rules the same way I, as a member of the House of Representatives, is not a civil servant. There is a difference between a civil servant and a public servant or officer. Jega falls under the latter.”

However, it was learnt that by norm, political appointees had at several times in the past been ordered to go on terminal leave even though they were not civil servants.

The provisions of Public Service Rules 100238 states that officers are required to give three months notice of their retirement from service terminating on the effective date of their retirement. This means Jega might be forced to proceed on terminal leave before the elections.

For instance, the tenure of Jega’s predecessor, Prof Maurice Iwu, was due to expire on June 13, 2010 but on April 28, 2010, President Goodluck Jonathan, ordered Iwu to proceed on terminal leave.

This is the same Jega Jonathan was praising in Kebbi State about two weeks ago during the Presidential Campaign in Birnin Kebbi. What has changed? Is this not the same Jega that conducted election that brought Jonathan to power in 2011?

We are ready to go any length to protect our vote and our country.

Here is video of Jonathan praising Jega in Kebbi just few days ago. Telling Nigerians how Jega has done well at INEC despite all the obstacles he faces as INEC Chairman.

Why push the Jega away at this crucial time? The body is 'independent', will FG please let them do their work without external intimidation? Pushing away a beloved MD by the governing board of a company makes employees' morale drop and develop mistrust.......

Inasmuch as I want GEJ to go, the free hand he's given INEC to do their thing since he started ruling, through his electoral reform, has made me reserve a special portion of my heart for him. I really hope he betrays my trust not.


If our own GMB eventually wins and sworn-in, 9ja will not 4get you GEJ, for bringing the much needed reform.

Let me break it to you. If Jonathan tries to outmuscle Jega with the military like he did with Sanusi, the courts are there to stop him in his track within 48 hours.

Read this directly from the law of the land:

The Nigerian Constitution is clear with no ambiguity whatsoever!

“There is a difference between a civil servant and a public servant or officer. INEC and its chairman are a creation of the constitution. Their operations and regulations are as provided under sections 156 and 160 of the constitution”.

“Which specifically says only INEC has the powers to regulate its own procedures and cannot be subject to approval or control of the president or any other authority thereby establishing its independence”.

He further explained that “furthermore terminal leave is a form of removal, however,you slice or cut it and section 157 of the constitution is very clear that the INEC chairman’s removal can only be initiated by two thirds of the senate and not by the president."

In 2011, GEJ was resoundingly popular with the average Nigerian. There was really no need to impose himself on INEC since it was pretty obvious he was going to win anyway.

Now that the man has lost the popular mandate he had in 2011, the real desperate man has revealed himself. The free hand u referred to will soon become handcuffed.

Trust GEJ at your peril.

If past INEC bosses / public servants before him had gone on terminal leave, why shouldn't he go?

Jega should do his job and stop playing to the gallery of opposition.

That's how he said he would NEVER postpone election.

He's never greater than his boss no matter how he thinks. Let him go and ask Emir Sanusi.
