The Election Petitions Tribunal sitting in Akure, the Ondo State capital, on complaints emanating from the National Assembly elections in the state on Tuesday nullified the election of a member of the House of Representatives representing Ilaje/Eseodo federal constituency, Kolade Akinjo.

The tribunal subsequently ordered for a fresh election.

The tribunal headed by Justice Antony Ogar hinged its decision on the fact that the candidate of the Peoples Democratic Party (PDP) for the April 11 election was not qualified to fly the party’s flag for the election.

Akinjo was the candidate of Labour Party (LP) in the inconclusive election for the Ilaje/Eseodo Federal Constituency before he dumped the party for the PDP alongside the state governor, Dr. Olusegun Mimiko before the last election.
Akinjo, who had since been inaugurated, was declared the winner of the election by the Independent National Electoral Commission (INEC) having scored the highest number of lawful votes in the election.

However, the candidate of the All Progressives Congress (APC), Lucky Ayedatiwa challenged the return of Akinjo by the INEC and sought the nullification of the election.

In his petititon, Ayedatiwa stated that Akinjo was not qualified for the election as he did not obtain waver from the necessary organs of the PDP before contesting for the election.

Ayedatiwa through his counsel, Yinka Orokoto, also argued that the respondent did not score the highest number of lawful votes for him to be the representative of the people of the coastal constituency.

But counsel to the respondent, Remi Olatubora, argued to the contrary that the candidate of the PDP was duly elected and that he obtained necessary waver before he contested the election.

The tribunal held that the PDP candidate scored the number of lawful votes and that the election was free and fair.

But the tribunal held that he was not duly nominated by the PDP for the election as he was still a member of LP when he contested the election under the platform of the PDP.

Finally d judiciary has found it's voice. Nullifying illegal elections of both APC nd PDP members. This is great news for all Nigerians.
Awaiting verdicts from Governorship Tribunals cos some Governors ve no business staying in the government house. Their suppose victories were eye sores nd big frauds.
