Good evening.

Before leaving the office this evening, I decided to do a once over on the front page of the forum (as I mostly just keep refreshing the politics section for updates) and saw a news item that caught my interest: Newtelegraph reported a case of a girl that died of injuries she sustained after being gang raped by six boys.

From the report, there were two victims but so far, only one has died. I Hope and pray the other makes it to full recovery.

The unfortunate and barbaric incident took place in Onicha Igboeze in Onicha LGA of Ebonyi state, South East Nigeria

Four suspects were said to have been remanded at the federal prison, Abakaliki; while the other two were granted bail at the behest of one Chief Ogbonnaya Okereke.

For convenience purposes, let's call the victim Amaka. (apologies to all the Amakas in the house).

Digest the preamble above as I introduce miss Ese Oruru.

The person Ese Oruru actually needs no introduction on this forum, and perhaps, across Nigeria. Governors, traditional rulers, ministers, police chiefs, senators, civil rights activists, political party bigwigs, mainstream media, religious leaders, legal luminaries, Nobel prize winners, educational heavyweights, and the ordinary man on the street are all familiar with the name Ese Rita Oruru. She rivals the famous Olajumoke in (un)popularity and had what she was associated with a thing of pride, perhaps she would have been the brand ambassador of countless brands across the country today.

Hers was a story of an alleged 13 year old Bayelsan kidnapped and forcefully married and converted to Islam by one Yunusa Yellow, a NORTHERNER

The story of Ese Oruru took the media by storm and literally BROKE THE INTERNET!! The social media, from facebook to twitter, was on fire for days on end as Nigerians were held spellbound by the unbelievably barbaric act of Yunusa Yellow, Ese's alleged boyfriend.

Nairaland of course wasn't left out of the orgy!! Google the words "ese oruru nairaland" and you'd be awe struck at the sheer number of threads that were created on account of that incident! Of course that was expected as nothing gets the forum in a frenzy more than a story of an alleged abuse of a Southerner by a Northerner, or a Christian by a Muslim!

Threads about the incident hurriedly made the front page and run several pages before losing steam- all after commentators must have taken turns to abuse Muslims and Northerners generally. These group of people seem defenceless on the forum and perhaps social media generally since they are not as internet savvy and social media inclined as people from other parts of the country.

At the receiving end of the relentless attacks were:

1. Mr President; his crime being that he's also a Northerner and a Muslim.

2. Emir of Kano whose offence is same as that of Mr President.

Some stretched their hate to their elastic limits as the accuse the president of personally sanctioning the incident since he's a "paedophile" as he also married Aisha "at the age of 13!!"

The attacks went on for days unabated culminating in a threat by Senator Ben Bruce to sue the IGP to the ICC! Abati also arrived the scene to take his own pound of flesh!! Femi Fani Kayode of course also took his share as he could not be left out of the fist fest, moreso, it was right down his alley!!!

Now folks, fast forward a week after, news breaks of a SOUTHERN teenager raped to death by SOUTHERNERS and social media and Nairaland is as quiet as a King Tut's Tomb!!

Why is this so Nigerians??!!

1. Is Ese's life worth more than that of the girl that was brutally raped to death??

2. Are the dramatis personae involved in a crime of this nature supposed to determine the level of press/general coverage/attention it receives?? Would the offence have been more criminal had the rapists come from another region or belong to another religion??

3. Is this the first time a crime of this nature is happening in this part of the country?? Why are they usually undereported?? Whose purpose is the press serving??

4. Following from the logic of the Ese Oruru's commentators, would it be appropriate if one tagged Christians or South Easterners as child rapists and murderers owing to the crime of six folks out of millions??

5. Was the case for Ese borne out of altruism and sheer concern for her welfare or was it more about POLITICS??

6. Would things stand where they are as regards the Ebonyi incident had it been reported the name of one of the culprits is Adamu??

Mull over these while I take a sip of water... Brb.

Now, as much as we can, we always try to pass ourselves off as modern, civilised and intelligent folks with unrivalled knowledge about the essence of humanity, and more often than not, in the course of doing so, the underbelly of our disdain for civility is revealed; ironic one would say.

Here's what I'm talking about: what Yunusa did was unacceptable in all ramifications and ought to be condemned by any right thinking human- but in doing this, some people, a good number, revealed their potential to do a lot worse than Yunusa could ever dream of doing. They literally forgot about the culprit and aimed the barrel of their cannons right at the heart of Northerners and Muslims generally! Some said they should be nuked and completely vaporised off the surface of the earth, that it is the panacea to world peace- these astonishing propositions put forward by supposed Christians who should know better!

Ese lives, Amaka is dead, but Yunusa's crime seems to surpass that of the Ebonyi Six. How convenient!

This type of scenario has been playing out since God-knows-when.

Let me digress a little at this point to share another nauseating instance of this double standard/hypocrisy.

Few hours ago, someone created a thread regarding the Senators who killed the Women's Rights Bill in the Senate. I don't know how reliable the news is but the op mentioned some Senators that supported the bill and three who didn't. Out of the three, two were presumably Muslims (from their names) while one was a Christian who sited a verse in the Bible to justify his stance against the bill.

Predictably when some people arrived the scene to comment, they completely ignored the Christian Senator and the reason put forward by him for his position and attacked the "almajiri Senators", inundating the thread with just about enough insults to knock the lights out a heavyweight boxer.

They became selectively oblivious to events of the recent past involving the Enugu state house of assembly where a similar bill was killed just the same way leaving one to ask: how many Northern almajiri honourables are present in Enugu SHoA that they succeeded in killing such a wonderful bill??

Mull over that for a moment reader...

Now tell us fellas, why have we chosen to turn the Northerners/Muslims into our preferred bogeymen and e-punching bags?? Exactly what crime did the North commit?? Since when did we jettison our democratic level tolerance for ethnoreligious diversity??

Politics is a game, and as such, must always have winners and losers. A people have an inalienable prerogative to vote whoever they think could best advance their course and interests; the Northerners saw that man in Buhari and the South Easterners and South Southerners saw the person in Jonathan. Each people threw their weight behind their preferred candidate and fate smiled on the former- how difficult is that to accept

Many a great democracy were built on such incidences of shift of power from a political party with time as it addresses mediocrity and dictatorship. It is in the best interest of those who lost to go back to the drawing board and realign their strategy. Take your defeat in your stride, learn from your mistakes, and take another shot at your goal- what comes of it would be anybody's guess.

As it stands today, Ese and Amaka's cases would, for a long time to come, remain a dark reminder of our hypocrisy as a people. They would remind us of how morally depraved we've become all in the name of politics.

The Abatis, FFKs and Muray Bruces of this world would remain completely mute over this as talking about it and condemning the culprits and the region from whence they come wouldn't do their political base any good. They all thrive on the hatred and mundane prejudices they've sown in our hearts, through their utterances, which we sometimes express indeliberately- meaning they've become a part of our character!

We must strive to exorcise that spirit of hate and kill it, lest it kills us all.

Common sense is dead in that North oh. So rape in south justifies abduction of minors from south. How does the crime of an isolated gang in Ebonyi justifies the support of sharia 'cults' & Emirs for Islamist crimes and criminals? We have a group who forces themselves on the people 'constitutionally' and another who have no cover. The OP is feigning stupídìty here.

Rape happens all over the world and it is a crime. We know that and condemn it whole heartedly.


Sharia court sentencing christian children to illicit marriages without parental consultation or consent is an exceptional precedent.


It take a criminal act and attempts to legalise it.


It legalises child kidnap, rape, forced marriage and islamisation.


No level of crime lalasticlala puts on the front page will justify the legalisation of criminal act by the Sharia Court and Emir.


Nobody will say anything but they are involving our christian children and tribes in their criminality.

The Sharia Court of Appeals recognized as a federal court of appeals (the Unified Courts System), is the most controversial of the judicial system. The Sharia Court of Appeals reviews cases involving Sharia law, particularly in the North and Northeast regions of the country.

However, this has caused controversy because while the Sharia Court of Appeals interprets and reviews cases relating to Islamic law, they must also interpret the common and customary laws of the other regions of Nigeria.

In doing so, the Sharia Court exceeds its jurisdiction under the constitutional law which give federal and state governments various powers. It undermines the principles of separation of powers and the two level federal system of government in which an overarching national government governs issues that affect the entire country, and smaller subdivisions govern issues of local concern.


The Sharia Court going outside state powers and local confines is striking down federal law, on the grounds that it exceeded the Constitutional authority of National Assembly.

Ese Oruru v Sharia Hisbah Commission
Ese Oruru was taken away by one Yunusa Dahiru from her home in Yenagoa, Bayelsa State to Kano in August 2015 while she was still 13 years old and without the knowledge of her parents. While in Kano she was forced into marriage, converted to Islam and her name changed to Aisha.For months, efforts by the young girl’s parents to get their child back from Yunusa and the Kanohe District head of Kura, Sharia Hisbah Commission proved abortive, no action was taken until media attention was drawn to it. Ese held at the Palace of the Emir of Kano was discovered to be 5 months Pregnant after eight months captitity.

Rita Chinedu Ukeje V Sharia

Madam Jessy Ukeje, a 77-year-old grandmother from Eluoma Uzuakoli in Bende Local government area of Abia State, is in pains her granddaughter was given out in marriage by a top official of Zaria City Local Government area, without the consent of her family.Rita, an SS 3 student of Top Spring Secondary School, Zaria, Kaduna State, was abducted by a commercial bus driver, called Usman, who held her captive in his home, denying her the chance of sitting for the Senior School Certificate Examination (SSCE) she had enrolled for.

Few weeks later, she stated, the council chief, who took her to his home and promised to make her available for settlement with the family, allegedly gave her out in marriage to Usman. The incident happened in Damagaji area of Zaria in Kaduna State, even as every effort made by the family to rescue the teenage girl from the clutches of her abductors have met with stiff resistance from the kidnappers. They took her into captivity after undergoing their Muslim rituals of bathing and feeding her with concoction as a way of turning her into a Muslim.

Then, they gave her to somebody to marry without the consent and knowledge of her parents. This is certainly against religion and against tradition

Mama Jessy, who could not hold back tears while narrating the abduction of the girl in her house in Eluoma Uzuakoli, alleged further that the girl’s abductors are after Rita’s mother, Joy Ihedinma Ukeje, for insisting that Rita must be sent back to her. She alleged that they had been sending assassins to her, forcing her to quickly run back to Uzuakoli from Zaria after several attempts on her life.

Ifeoma Nichodemus v he Sharia Court Kaduna
IFEOMA, now Aisha, is the daughter of Mr. Ndubuisi Nichodemus. She was living with her parents, in the midst of the Hausa community in Zaria, Kaduna State, until May, 2014. On that fateful evening, Ifeoma had left the house in protest against the authority of her moth­er to question her for returning late to the house on the day. She simply walked out of her parents’ compound into a neighbour’s house, and since 21 months ago to be precise, the family is yet to set their eyes on her. Ifeoma, now 16, have been converted to Islam and married off. The Sharia Court handling the mat­ter keeps adjourning the case and as a result, we are still where we were last year”

Charity v Sharia Court Minna
MINNA—MISS Charity (Aisha) Uzoechina, the lady that was allegedly forced to convert to Islam and kept in the palace of Etsu Nupe, Alhaji Yahaya Abubakar, for the past four months, will remain with the monarch until September 17. Charity cannot be released by the Emir to either the parents or anybody until the case instituted by Charity is vacated by the Sharia court in Bida, Niger State. The Sharia court kept adjourning the case the lawyer who handles her controversial case in Sharia court makes arrangement to marry her without the consent of her parents, but the Niger state Government called it off.

Blasphemy and apostasy
A Sharia court may treat blasphemy as deserving of several punishments up to, and including, execution. In many predominantly Muslim states, conversion from Islam to another religion is illegal and often a capital offence.

In 2014 a Nigerian man, Mubarak Bala was forcibly committed to a psychiatric institution in Kano for eighteen days, where he was forcibly drugged after stating that he was an atheist. The International Humanist and Ethical Union took up the case, stating that Bala's human rights were violated.


Riots
There have been numerous riots over the implementation of sharia law, primarily involving non-Muslim minorities in the states which implemented the system. One such riot killed over 100 people in October 2001 in Kano State.


Executions

In 2002, the first execution of a man under Sharia took place in Katsina State; Human Rights Watch condemned the execution.



The Supreme Court Solution via Judicial Review

The Supreme Court uphold and declared Sharia Court to be ultra vires in a narrow or broad sense. Narrow ultra vires applies if an administrator did not have the substantive power to make a decision or it was wrought with procedural defects.

Broad ultra vires applies if there is an abuse of power (e.g.,unreasonableness or bad faith) or a failure to exercise an administrative discretion (e.g., acting at the behest of another or unlawfully applying a sectional policy) or application of discretionary powers in irrational and wrong way.[5] Either doctrine may entitle a claimant to various prerogative writs, equitable remedies or statutory orders if they are satisfied.

Kidnap is a very serious offence and when it is done for sexual gratification, it is a heinous crime. The Sharia court is a form of customary court to the North. In that sense, it has no jurisdiction to hear cases of people not part of that culture. It is like a Igbo customary court hearing the case of a Yoruba, claiming they have converted to Igbo.

Custom refers to origin and ancestral linage, if a person does not have their roots in islam then Sharia court has no grounds to hold or hear the case. The Sharia system was introduced for people who customarily have followed the religion of islam.

It is illegal and unconstitutional to steal peoples child and claim forced conversion to islam, as a bases to Ra.pe and forced marriage/ conversion to islam, without any form of consent. Whilst handing out death sentence to Muslim that desire to convert to Christianity freely without abduction or coercion.


Why drag us Christian southerners into uncivilised and criminal customs? Why are u stealing our children and raping them? Is sharing a country a crime? Can u not face and marry your muslim children?

Didn't you read where the Emir directed for the matter to be handed over to the state police AIG; including a copy of the same orders released to the press as evidence of his non complicity; how does that amount to shielding of any body - why must you and your ilk continue to expose your ignorance and embarrassingly mental laziness to comprehend?

@ OP your problem is lack of discernment.

That you do not know the difference between the two cases is shocking to me.

Rape is a crime. Crimes happen in the North as well as in the South.

In the Yunusa Yellow case:

A Northern Moslem adult kidnaps a child from Bayelsa, converts her to Islam through the active connivance of the Sharia Commision, keeps her under the custody of the Kano Emirate, sleeps with her while the authorites actively prevent her mother from rescuing her daughter for many many months . Worse, the mother's life is threathened and she runs for dear life...

Here Yunusa, Sharia Commision and the Emirate are key characters in Ese's kidnap story.

Do you see the difference ? Do you now recognize the reason for the outrage in the predominantly Christian South?

All rapist should be made to face law of their respective countries. But in the case of northern Nigeria, all accused persons are shielded by their emirate councils and sharia courts.

Blasphemy and apostasy

The Supreme Court Solution via Judicial Review

The Supreme Court uphold and declared Sharia Court to be ultra vires in a narrow or broad sense. Narrow ultra vires applies if an administrator did not have the substantive power to make a decision or it was wrought with procedural defects.

Broad ultra vires applies if there is an abuse of power (e.g.,unreasonableness or bad faith) or a failure to exercise an administrative discretion (e.g., acting at the behest of another or unlawfully applying a sectional policy) or application of discretionary powers in irrational and wrong way.[5] Either doctrine may entitle a claimant to various prerogative writs, equitable remedies or statutory orders if they are satisfied.

Kidnap is a very serious offence and when it is done for sexual gratification, it is a heinous crime. The Sharia court is a form of customary court to the North. In that sense, it has no jurisdiction to hear cases of people not part of that culture. It is like a Igbo customary court hearing the case of a Yoruba, claiming they have converted to Igbo.

Custom refers to origin and ancestral linage, if a person does not have their roots in islam then Sharia court has no grounds to hold or hear the case. The Sharia system was introduced for people who customarily have followed the religion of islam.

It is illegal and unconstitutional to steal peoples child and claim forced conversion to islam, as a bases to Ra.pe and forced marriage/ conversion to islam, without any form of consent. Whilst handing out death sentence to Muslim that desire to convert to Christianity freely without abduction or coercion.

First of all let me categorically state that Islam does not condone Kidnapping, rape, forced marriage or conversion; and that anybody who does that would have disobeyed Islam.
This does not mean, however, that there will be no Muslims who will disobey Islam just as there will be no Christians who will disobey Christianity.
Condemning either religion for the individual actions of deviants within them is downright stupid and ridiculous.
Secondly, anybody who believes everything written in Nigerians newspapers needs to have his head re-examined because everyone is aware of the unprofessional junk journalism we have today; never expect unbiased reporting when it comes to religion because the predominantly Christian owned and controlled media would understandably always tilt towards christinity at the expense of Islam - an intelligent discerning reader should always be weary and able to read between the lines.

For example, in Ese's case the prosecutors have had to drop the charges of forced marriage and conversion after thorough investigation as against what the press was falsely reporting to the gullible believing public.
