In the year 1999 under the Democratically elected President Olusegun Obasanjo led government , an attack was carried out by the military in the predominantly Ijaw odi town in kolukuma opokuma local government of Bayelsa state.

The attack by the military was supposedly in response to the kidnap and killing of twelve soldiers in the village and after the expiration of an ultimatum by the government for the elders to produce the culprits, the military swung into action. Every building in the village was razed to the ground except the Bank, the health center and the Anglican church..
Nnimmo Bassey , Executive Director of Environmental Rights Action, claims that nearly 2500 civilians were killed.

In 2014, The Good luck Jonathan administration paid the sum of 15 Billion Naira to the Odi community as compensation for the massacre..

My question however is , why as President Olusegun Obasanjo not be tried and brought to book over the Odi massacre bearing in mind the Fact that the incident occurred under a democratic government.
I would love to know the legal and informed opinion on experts on this bearing in mind that this killing constitutes crime against humanity and against the law as this act is the same act that African leaders like Charles Taylor, uhuru kenyatta ,Laurent Gbagbo and some others were brought to book for ....

The attack by the military was supposedly in response to the kidnap and killing of twelve soldiers in the village and after the expiration of an ultimatum by the government for the elders to produce the culprits, then did the elders produce the killers? the community must be prosecuted for killing peace keepers first or you think the soldiers do not have families?

The topic was borne out of an intellectual discussion o had with certain individuals when we rubbed Minds on the recent Gambia ,jammeh and barrow power tussle ..
The discussion entered into the issue of Gaddafi and Idi amin before the case study of obasanjo and odi came up.

Of course he should be tried and even sentenced to death. I think my community and all Ijaws should take him to ICC for crime against humanity despite the compensation.
HE NEEDS TO PAY DEARLY.

it's only foolish ijaws ,after seeing wat d Nigerian state had done to us dat will still support diz hellhole. They should kip waiting for resource control dat will never com. As for me and my household,we will vote yes for any Biafra referendum. Even Rex Lawson, a late ijaw musician of d 80's ,most of his songs were praising Biafra and Ojukwu. It's only some foolish ijaws of diz generation dat think dey are wise simply bkoz de Av gone to school. With all their school, c haw d region looks like . Shame on any ijaw man dat supports diz country after d country through a Yoruba man adekunle killed one of their greatest leader Isaac Adaka Boro. D same country through another Yoruba humiliated their son DSP Alameseigha and bombed their mothers and fathers in odi. The same country is still harassing their daughter Diezani and son GEJ as if de are d only corrupt politicians dat looted diz country. If we(IJAW) like make we no wise join hands with IPOB

Though I condemn the Odi massacre, I still insist that President Obasanjo did what he did in accordance with his powers as President and Commander in Chief.

The problem is that the Odi community was wrong to harm security officials and dared the might of the FG. It is of a truth that killing/kidnapping Military officers on duty is a declaration of war against the State, unfortunately, our some hoodlums in Odi followed the ignoble path.

The blame in the Odi debacle falls on the Odi community, for not doing enough to fish out the perpetrators and spared the area of military action. Another party to blame is Bayelsa state government of Alamesigha, for not taking the initiative to see justice prevail. Of course, President Obasanjo should have explored other means though the military action was within his power.

A similar scenario almost played out in Okrika in 2006 (or so), the elders intervened and the kidnapped policemen were produced.

Obasanjo did the right thing and he will NEVER face any court for his actions.

The odi people murdered in cold blood innocent policemen that were sent to restore order in their community. As a matter of fact, they mudered the first batch of policemen. Another batch was sent and they were killed in cold blood.

Not only did they murder these men by beheadjbf them, they also refused to release their corpse for proper identification and burial despite several pleas/deadline from the Nigerian government.

To add more salt to injury, the community shielded those responsible for the heinous crime and refused to hand them over to the state or federal government for prosecution.

What the odi people did was totally unacceptable. Those innocent men were fathers, brothers, husbands, uncles and nephews.

Most civil right movement groups are fully aware of the atrocity committed by the odi people which is why everyone left the odi people to their fate and nobody is calling for obasanjo's head.

Why should innocent civilians in Odi also be murdered alongside the culprits..?? Are you telling me everyone in the village had a hand in the killing of the police officers ??

Common, This happened under a civilian government.. violence is never the way !!! Why nor fins a way to arrest the elders or King and interrogate them to bring out the culprits ??

Sir , this happened under a civilian government.. under the provisions of the Rome statute guilding the ICC, the act ordered by President obasanjo is crime against humanity..

Should we say certain people in surulere shot nine policemen, Buhari should send soildiers and kill everybody in surulere ??

Fine , obasanjo acted withnin the confines of his powers but was it judiciously used..Remember no relief plan whatsoever was provided for survivors or remnants of that massacre..

No matter the offence committed, this people were part of those who voted him into power ...Why should the righteous perish with the wicked ??

My Dear Brother, as an Ijawman I was emotionally affected but here is the problem.

The hoodlums in Odi not only killed Policemen but also kidnapped military officers that were sent to restore order. That act is a declaration of war!

Secondly, the Ultimatum to produce the Soldiers (dead or alive) was clearly rebuffed, hence, sending signal that they give no damn.

Morally, lives are sacred but legally, Obasanjo acted within the confines of his Power as President and Commander in Chief.

Similar thing happened in 2009 in Gbaramatu Kingdom(Delta state) when militants attacked military officers and vessels, Yar'adua went on bombing siege of the area.

Goodluck Jonathan took a similar step in 2010 when "General" John Togo felt that he can challenge the State.

The thing is we must understand that no society can be a law of itself. We must submit to the laws of the Land to avoid calamity on our people.
