Nigeria’s Ministry of Foreign Affairs said the Federal Government has resolved to remain with the International Criminal Court (ICC). The Spokesman of the ministry, Dr Clement Aduku, clarified the Federal Government stand in Abuja on Wednesday. Aduku said Nigeria’s stand on the issue as explained by the Foreign Affairs Minister, Geoffrey Onyeama, has not changed. The African Union had in January during plenary at the 28th AU Summit in Addis Ababa called for collective withdrawal of its members from the Court. The summit argued that African countries were not fairly treated by the court, hence members should withdraw. Onyeama said Nigeria did not subscribe to strategy adopted by AU for collective withdrawal from the ICC. The minister said that when the issue came up during a meeting, several countries kicked against it. According to him, Nigeria and others believe that the court has an important role to play in holding leaders accountable, hence Nigeria fully stands by it. “Nigeria is not the only voice against it; in fact, Senegal is speaking very strongly against it. Cape Verde and other countries are also against it. “What AU did was to set up a committee to elaborate a strategy for collective withdrawal. “After, Senegal took the floor, Nigeria took the floor, Cape Verde and some other countries made it clear that they were not going to subscribe to that decision,” he said. Onyeama said that a number of countries also took the floor to request for more time to study it before acceding. He said Zambia, Tanzania, Liberia, Botswana and a host of others were not willing to withdraw from the court. While faulting AU’s position on ICC, Onyeama stressed that each individual country willingly acceded to the 1998 Rome Statue on the setting up of the court. “Each country freely and willingly acceded to the Treaty and not all of the members of the AU acceded; each country acceded individually, exercising its own sovereign right. “So, if each country wants to withdraw, it has the right to do that individually.’ “AU, which was not a party to the Rome Statute that established the court, should not be developing a strategy for a collective withdrawal for something that each country entered into individually. “Those who feel they want to withdraw should do that individually,” Onyeama said. NAN reports that three African states in 2016 publicly declared their intention to withdraw from the court in what seemed to be a continental domino effect. The countries are Burundi, South Africa and The Gambia, with reports that Namibia, Kenya and Uganda were contemplating withdrawing from the ICC The court has been repeatedly criticised by African states as an inefficient, neo-colonial institution of the Western powers to try African countries. This argument is supported by the fact that nine of the 10 situations under investigation, with three others under preliminary investigations, involve African countries. African state, which are parties to the Rome Statute make up the biggest regional membership, comprising 34 of the 124 members. i really like AU move on ICC.....but,i want unstabele african nations to remain,while countries/regions like southern Africa,kenya,ethiopia etc should withdraw.the entire central and west Africa,xcept ghana,shud remain 2 Likes |

All these western institutions were created to enslave Africans, they are agents of neo-colonialism. It is foolish for African leaders to send our black brothers to the white men for prosecution. After centuries of slavery and decades of imperialism we still allow the whites to help us make our decision. I was annoyed when ECOWAS had to take permission from UN before they could send troops to the Gambia, can't we make our own decision without involving the white men that exploited our continent for centuries, raped our female ancestors aboard the slave ship, use them on their farms and grounded our civilization. So many white men have committed crimes against humanity but the ICC would over look it but when an African man does that they would start barking like a dog calling for his extradition to the hague, African leaders should wake up from their slumber and AU should stand up to her responsibility. Always confused with foreign policies, other nations can do as they like but we don't have the privilege, now AU our continental block is pushing for withdrawal so we can rely more on AU and ECOWAS courts absent western influence, the US and UK donating prisons for African leaders are no signatories, they can strike at any country in the world without consequences yet the dundee Onyema feels it was just about how we entered never sees the bigger picture, anyways, was he not the Mofo that supported Hillary clinton? was he not the Ode that advised the use of military force in Gambia in a recessive economy instead of supporting Senegal tactically, never mind that ECOWAS never came to our aid in the fight against Boko haram. bloody block head!! |

dermmy: Even the United States have to take permission from the U.N. before sending troops, same with Britain, that us the procedure. Any African leader who commits war crimes against his people should be handed over to ICC and dealt with, no sentiment about it at all. |

Wow! This is good! The ICC was established on the principle of complementarity, i.e to assist national judicial systems. But in a situation where national courts are incapable and unwilling to prosecute crimes of concern to the international community (War crimes, Crimes against humanity, genocide and Crime of Aggression), the ICC can step in. African judicial systems have shawn this incapacity and unwillingness, therefore necessitating the incoming of the ICC. Western courts on the other hand, have been able to prosecute individuals found guilty of war crimes, crimes against humanity, genocide and crimes of aggression. There is also the principle of jurisdiction and gravity. Most of the crimes outside Africa (e.g Syria) are not under the jurisdiction of the ICC as Syria is not a state party to the Rome Status. However, the Security Council can refer such case to the ICC just like they did with Sudan and Libya. But they remain adamant mostly because of veto powers interests in the Middle East. So the accusation of bias should be channeled to the SC and not the ICC. The argument therefore, that the ICC is a neocolonial tool in the hands of the Western Powers is irrational and pseudointellectual. African leaders are very despotic and prone to committing war crimes and crimes against humanity, therefore their hatred for the global Court. AU's position on the other hand is a safe face adventure to divert attention from the material to the immaterial. |

Ugosample:...what of sudan president bashir that has been indicted by icc what has happened?....what of kenyatta of kenya that was indicted too after election violence, what has happened?....after his romance with west, most especially america they forgave kenyatta of all his sins....Icc is not strong at all and its impartial/bias Thats my point.... |

davereal: I disagree, the US has a SC veto but not a signatory to the Rome statute, SC is more powerful than the ICC and covers global jurisdiction, why would a country have the right to stay or leave the ICC when the SC can hand down any sanction they deem necessary to any country? The US said they have strong institutions reason they don't need the ICC, but what about weak institutions protected by the US by virtue of their SC veto example Bahrain? I think the way it should play out is this; the SC should have its own court where your summon should be decided by the super powers as it were. |

The keen student of African geopolitics understands that all decisions regarding foreign policy in African francophone countries come directly from Paris in that that obscene relationship between France and her former (lol) colonies, called (stupidly) "Francafriqe". Most other mainly anglophone (i detest that term ) ,have policies crafted so at the behest of the great powers,but not entirely true though. Most lusophone countries maintain a barely concealed interest in African affairs, they are more concerned with spreading the language of conquest (Portuguese ) ,watching Brazilian media and dancing kizomba, than attending to matters of continental interest. Arabophone countries are the guest who only show up when there is a guarantee of cake at the party - the neighbours who only cry when they're out of salt and would never say hi when they pass you on the street. Which brings me to the position my country ,Kenya, has taken in this debate on ICC. We have lobbied hard for the ICC exit yet done nothing for the lives lost during the unfortunate episode in 2007/8 after elections. Lives lost, property destroyed, no prosecution for perpetrators , no justice for victims. Most vocal African country for ICC exit. I need a stiff drink. |
