Section 145 :
‘Whenever the President is proceeding on vacation or is otherwise unable to discharge the functions of his office, he shall transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice President SHALL perform the functions of the President as Acting President.’


Buhari cited that section of the constitution amd transmitted a letter

The section does not even empower him to mention anybody as acting President if not he could have nominated his wife or mentioned any other person.

As soon as that letter was read on the floor, the VP becomes the acting President AUTOMATICALLY until another letter comes indicating that the President is back.

The reason Jonathan had issues was because such letter does not exist and it led to a constituional crisis hence DOCTRINE of NECESSITY was invoked to be able to recognise the then VP as Acting President.


STOP looking for trouble where none exist.

The sad truth is that one ambiguous word in a document can adversely affect the meaning and aim of the letter in law.
Whoever drafted that letter is very smart I must say.
It's not about sentiments but concern for the wellbeing of our nation.

Nigeria and Africa as whole will remain under developed as long as the chunk of youths available think this way. I think this is more of a comprehension problem than sarcasm. Coordinator or acting vp what difference does it make, since the president coordinates the affairs of the country amd has delegate it to the vp.

Deji pls forget about what they actually wish and say the truth, Buhari handing over to his VP as ordinary Coordinator is not fair enough.
We can't continue to ridicule everything in this nation and at same time except ourselves to be great.

Professor Yemi Osinbajo reacted to concern that President Buhari did not hand over power to him

- He said the president duly handed over power to him





Professor Yemi Osinbajo has waded into the controversy surrounding whether President Muhammadu Buhari duly handed over power to him when he left the country.

President Buhari had left the country on Sunday, May 7 for medical treatment and the vice president was duly expected to replace him in acting capacity.


On Tuesday, May 9 however, there was observation from Senator Mao Ohuabunwa that the president did not properly transfer power to the vice president following a letter read by Senate president, Bukola Saraki of the president’s medical trip.

The letter read: “In compliance with Section 145 (1) of the 1999 Constitution (as amended), I wish to inform the distinguished Senate that I will be away for a scheduled medical follow-up with my doctors in London. The length of my stay will be determined by the doctor’s advice.

“While I am away, the Vice President will coordinate the activities of the government. Please accept, the distinguished Senate President, the assurances of my highest consideration.”

Ohuabunwa criticised the letter saying there was no position of coordinating president in the constitution and that Osinbajo should have been duly addressed as acting president.

He said: “Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is unable to discharge the functions of his office, until he transmits to them the written declaration to the contrary, such function shall be discharged by the Vice- President as Acting President.

“Mr. President, I don’t think in our Constitution we have anything like ‘coordinating president’ or ‘coordinating vice president.’ It is either you are vice president or you are acting president and any letter (on transfer of power) should be unambiguous and very clear. So, I am saying that this letter really does not convey anything because ‘coordinating’ has no space or any place in our Constitution.

“We have been having (receiving) letters like this in which he will tell us who is the acting president and we will know who to deal with as a Senate. This is the highest legislative body of any country and if you are sending us a letter, it should be direct, unambiguous. So, I am saying that this letter, for me, is not right and maybe it should be sent back.”

Osinbajo in an answer to a question on twitter confirmed that Buhari handed over power to him as acting president as specified by the constitution.

Mr. Right thinker you think those that drafted the Constitution didn't know about the word 'Coordinator' and rather used Acting President.

Relax and go ask your Lawyer friends the legal implications of the word Coordinator being used. What is so difficult to use ACTING President Mr. Justified?

The real question is the frame of mind that informed the writing of that letter. A "Co-ordinator" is more like a class "monitor" an Acting President should act like an EXECUTIVE PRESIDENT. Even Okonjo-Iwealla was a Coordinator.
We have every reason to call out the writer of that letter for the condescending language and the President for signing it.
For those of you who have lived the last two years creating excuses for all the mischief and missteps of this administration, you should be ashamed of yourselves.

The President's kitchen cabinet or rather handlers are bunch of mischievous guys. PMB may not have taken note or read meaning of the word "co-ordinating". PMB's intention is very clear. He is temporarily handling over the affairs of governance in the hands of his Vice. The constitution does not recognise the words "co-ordinating the affairs of Government" but rather Acting President. The brouhaha about the whole affair should be laid to rest.

Besides, is it not the same National Coordinator that will sign 2017 budget in PMB's absence and inaugurate new Ministers? So what are the functions of a President apart from ceremonious and constitutional duties like these?
