Judicial Rascality and Abuse of power: MAGISTRATE NSIKAK IBAGAN V ELIJAH ASUQUO
We consider it necessary to report some over flogged decisions and transfer of aggression of our judicial officers. Judiciary is the only hope of a common man and if the judicial officer descend into the arena of the bar to persecute an innocent Individuals
On Wednesday 14th June 2017, the driver of Deeper Life Corpers fellowship Akwa Ibom State bus, Mr Elijah Asuquo was arrested by men of FRSC, and arraigned immediately before mobile court presided over by Learned Senior Magistrate Nsikak E. Ibagan.
Mr Elijah was arrested for offence of not possessing fire extinguisher in the corpers bus, when arraigned, he pleaded not guilty and presented the fire extinguisher before His Worship. Only to discover that the fire extinguisher has expired not knowing to Elijah. Immediately His Worship discovered that the fire extinguisher has expired, without option to defend himself or fine, The angry Magistrate convicted him and sentenced him to 7 days imprisonment without option of fine. Its not that he doesn't have fire extinguisher, he has but not knowing it has expired.

Eye witness and the FRSC prosecutor confirmed that the trial and sentencing of Elijah was transfer of aggression because some other people were arrested for not possessing at all and they argued with His Worship and were able to get option of fine. The Learned Senior Magistrate couldn't separate his emotions from case before him.
May I draw your attention to provision of Section 9(11) of FRSC establishment Act, it said anybody that commit and offence like not possession of fire extinguisher should be fined #3,000 or sentenced to Imprisonment IF HE REFUSED to pay the morning. Elijah was not given fine at all, the Magistrate decided
