The registration of trademarks is in five main stages, viz: Name Availability Search, Acknowledgement, Acceptance, Publication and Certificate Issuance.


​1. Name Availability Search:

An availability search will be conducted ​to confirm that such a mark is available at the material time of that search. It then behoves the applicant to take immediate steps to register the name before any other applicant presents a similar name/mark for registration. Otherwise, such a name will remain open and available to any other more diligent applicant.


​2. ​Acknowledgement
If a name is deemed to be available, the applicant will be issued an ACKNOWLEDGEMENT upon the payment of the applicable registration fees. This means that the Trademarks office has received your application, for processing. This takes up to five business days.

3. Acceptance:
Upon completion of the registration, the applicant is issued the ACCEPTANCE indicative that the mark is registered. This process takes approximately four weeks.

The actual registration Certificate will however issue only after publication.

​4. ​Publication
The Trademarks Office publishes all ACCEPTED applications in its Trademarks Journal to enable members of the public react thereto within 30days.

​5. Certificate
The Certificate will be issued if there is no objection to that mark after 30 days of the publication in the Trademarks Journal.
The publication is meant to be done quarterly but in reality, it is done at the convenience of the Trademarks office. Owing to reasons of finance or other constraints, the journal is not published regularly and this may delay the issuance of the certificate for years.

The ACCEPTANCE​ is generally regarded as proof of registration of a trademark in Nigeria. Thus, most practitioners only commit to the ACCEPTANCE stage in order to avoid undue rancour with impatient Applicants over delayed certificates.

Processing to Acceptance costs 35k inclusive of all fees and courier expenses.

Publication and Certificate costs an additional 25k making it a total of 60k for registration in one class.

There are over 45 classifications of Trademarks being a convenient grouping of marks according to the nature of the products from water, electrical to tyres etc.

I have a company called Tectono Ventures Limited, which is registered with the Corporate Affairs Commission. I have not registered a trademark with Tectono. Can someone else register Tectono as a trademark
