Rev. Dr. Paul Emeka Goes Back To Court To Reclaim His Seat And Finish Up His Tenure!
Rev Dr. Paul Emeka, the ousted General Superintendent of the Assemblies of God church, has finally gone back to court at the Federal high court Enugu, in 3 separate suits- suits no: FHC/EN/CS/120/2017,
FHC/EN/CS/121/2017,
FHC/EN/CS/122/2017,
Against 25 persons known as the Defendants, through his attorney, Ifeanyichukwu Okonkwo, claiming a total of 2.8 billion Naira. His grounds are;
that his purported sack and suspension was a sham, and carried out by people who were not even members of the church Incorporated trustees, working with the Corporate Affairs commission who agreed with an illegal instruction and included two others: Rev pastor Ejikeme Ejim and Rev. Godwin Akpan Amaowoh (PhD) as trustees in clear violation of the provisions of board appointment ; sections 597(2) and 599(part c) incorporated trustees companies and Allied matters Act, issuing another certificate CAC/IT/NO/349, 18 April, 2015, against the original certificate CAC/IT/NO/349, 18 September, 2012. Noting that this interruption was outrageous, and merits punishment as it discloses malice fraud, cruelty, flagrant disregard to due process and the rule of law.
that the accounts of the Incorporated trustee of the AG Nigeria was interfered with, and billions of monies withdrawn between the period,15 April 2014 to 24 February, 2017, in the 12 financial institutions listed as Defendants below, therefore praying the institutions through the court to render a financial account of all withdrawals and debits, and return it back by the groups who changed the mandate because, the financial institutions whose duty was to respect the rule of law, flagrantly disregarded due process of the Law, and failed to protect the church assets knowing that Rev, Dr, Paul, was still in court on his dismissal.
That the IGP, Nigerian Police and the Commissioner of Police Enugu state’s takeover of his residence at Ozubulu street, Independence Layout and interference with properties was done in flagrant disrespect to the rule of Law and an Embankment on self-help as they failed to maintain the status quo pending the final judgement of the supreme court in the matter.
The 25 defendants have all being served, and they are yet to respond while a date is yet to be fixed for the hearing
