Our able Governor Akinwunmi Ambode, we hereby bring to your notice to save our soul at Love Estate, Mowo Kekere, Ikorodu. On the 7th and 9th of November, 2017 a contravention notice and demolition notice were served respectively by the Office of the Honourable Commissioner for Physical planning and Urban development through the directive of MR OKUNIYI of the Technical Services Department(TSD) of the Ministry of Physical Planning and Urban Development.

About 70% houses within our estate have been marked for demolition effective in 48 hours time from the day demolition notice was served.
The reason for serving this notice is based on the fact that we do not have approved building plan before erecting all the structures. Upon receipt of this notices Members from our C.D.A, Love Estate C.D.A were delegated to follow up at the (TSD) MPP&UD office whereby MR OKUNIYI told our delegates that he is the voice on the field and in the office and he takes pleasure in demolishing any standing structure that lacks Approved Building plan in Lagos State because it’s his job and he gets promoted whenever he achieves such task.

From our own understanding, under the Urban and regional planning and development law 2010, Page C56, Part V, Section 59. Enforcement shall include:

(a) Contravention Notice

(b) Stop work Order

(c) Quit Notice

(d) Seal-up Notice

(e) Regularization Notice; and

(f) Demolition Notice.

But the (TSD) MPP&UD has acted outside of the law because they served just (a) Contravention notice and jumped to (f) Demolition Notice.
This act of the MPP&UD has caused lots of panic, havoc to landlords within our estate even beyond reparable simply because old ones has been hospitalized, people with health issues has died due to this wrong act of the Ministry.

If we also go through the same law Page C56, Section 69. (Penalty). States that:

‘Any person who fails to comply with the terms of enforcement notice issued and served under the law shall be guilty of an offence and liable on conviction to fine as specified in this law and regulations made under this law’.

So therefore we don’t see any reason why the Ministry of Physical Planning and Urban Development should go through with demolition of structures work millions of Naira within out estate simply because it lacks building plan approval but rather we should be subjected to pay penalty and also enforce us to regularize the necessary document and building approval.

Also it is factual that the Honourable Commissioner for Physical Planning and Urban Development and MR OKUNIYI of (TSD) MPP&UD has special interest in claiming the parts marked for demolition within our estate for one reason or the other known to them because the question we are asking ourselves is that the 30% left unmarked does not have 2% houses that has building plan approval.

Also if the entire Ijede, Ikorodu is checked we are certain that hardly will we establish 90% buildings standing having building plans approvals so why can’t the Ministry of Physical Planning & Urban development starts this operation demolition from Itamaga where Ijede Community Starts from, at least they would have demolished housed worth billions of Naira before getting to 70% they are proposing to demolish within Love Estate, Mowo-kekere.

Our able Governor Akinwunmi Ambode, we voted you in en-mass at Ijede, Ikorodu, we know you are a Governor that Listen to the voice of the people so we plead that you should step into this matter by stopping the demolition immediately because it is an illegal act and also investigate critically the office of the Honourable Commissioner for Physical Planning and Urban Development and also MR OKUNIYI of (TSD) MPP&UD on their interest on the 70% parts parked for demolition within Love Estate, Mowo Kekere before it goes beyond reparable and becomes a political weapon for your opposition come 2019 to hold on to.
