Vice President Atiku Abubakar will know on March 7 whether he is constitutionally eligible to contest the presidential election in the April polls.

This issue is going to be the major implication of the judgement that would be delivered by the Federal High Court in Abuja on the day in a suit brought by Atiku challenging his indictment by an Administrative Panel of Inquiry for abuse of office.

I wish we can all wait for the judiciary to make the final pronouncement on the issue of this indictment. Neither Atiku or OBJ are bigger than Nigeria and since I'm assuming we're all democrats in this forum, it would be nice to wait for the court before writing political obituary

what exactly does the constitution say about his situation?
I think the nigerian constitution should be made as clear as possible
so every citizen know what the deal is especially politicians.

every decision is being handled in court and this takes several months/years even
theres also the issue of "juridiction this juridi that, politicians saying this or that court
don't have the power to hear his caseĀ  undecided

just few days to election things are still no clear, what if; in the name of Fair play
the elections are delayed for the case to come to an end with an appeal?

Atiku's fate is very clear, he is not part of the election he is just giving himself hope as if the court rules otherwise INEC will let him in when the deadline for changing candidates is gone.

Counsel to the vice president, Adeniyi Akintola, had pleaded wih the court to deliver the judgement not later than March 7, 2007 in view of the fact that the INEC would conclude on the issue of substitution of candidate or disqualification of candidates as the case may be and publish same on March 8, 2007.

Its not very difficult to know when AC has planted something on the media. Who does not know that substitution of candidates ended by February 20 and all INEC is looking to do by March is release of candidates names.

Frankly speaking, does INEC have any right to disqualify a candidate? undecided

If they do, am realy wondering why Alao Alaka d Adedibu 'son' is allowed to contest in the elections, or why Omisore ( who jungle court found guilty of d murder of Ige) was allowed to contest, while in detention, n sworn into the senate immediately after his release,

so since wen did Iwu cee d 'light' and wot part of the constitution gives him the right to disqualify any candidate, ?

and b4 u come 4 ma flesh, its not only AA dat was 'disqualified'!

My sister the constitution does not empower INEC to disqualify any candidate but the constitution states clearly that anybody indicted by a panel set up by the FG can not contest elections in Nigeria. In this case it is not INEC that disqualified ATIKU but the constitution. In the case of the people mentioned in your posting non of them was indicted by any panel so they have the "godfather given right" to contest elections. Anyway, Ribadu has promised Akala not to rejoice because he will never survive the next dispensation even if he won in oyo state
