Hi property pros in the house,

It is my pleasure reaching you all at this time.

Please I need your advice on this.

There is this family house by the major road in one of the big commercial hubs in Lagos. This land would be great for bank because there are many banks on the road already.

Now, this house was built by my paternal granma who died about 35 years ago. She had six children. Several attempts have been made by one of grandma's children to sell the house but he's always been unlucky to get into 419s. The fraudsters would have actually made away with the property save for other siblings who needed to cosign documents but had never wanted to sell and would never sign.

Now, the family has really expanded and these siblings are already aging. The only way forward now is to sell the house and everyone should go and invest it on something that would help them more instead of the peanuts they currently get as rents (The property should sell between 60 and 80 millon).

But there's one challenge. Recently, one of the siblings (a single mother) died and people who were with her just carried her corpse to her mum's house and buried. They had even buried her in the house before they infomed her siblings that she had died.

So, like I said, the siblings are aging and they have children's children already. The structure on the house is just face me and face you, making the potential of the land to be overly underused. It will be more useful if a firm like bank procures it and it will ultimately boost the area's economy.

So how does one go about this, not forgetting the person that was buried there?

1 the owners first son owns the house, first grand son and so great grand son each first of their fathers.

2 Lease the land to a bank for a hundred years, the rest of the generations should go kick rocks.

First you need to get the consent of everyone who has a stake in this cos they are the ones who'll share the money. Be transparent o. Cos if you with hold any info, one person can scatter the whole deal.
Get a lawyer to advise you on laws regarding exhuming a dead body and property laws.
Once you have satisfied the requirements and have exhumed and reburied the body elsewhere, the land is ready to be sold

couldn't the house be sold and the body exhumed immediately after; because the plan is to buy and build a house for the woman and she would be buried there. All this are to be done from her share in the sale. Her children will take charge of the house and whatever remains in her share after the house is built for her. Mind you, the house will be built in new site.

This is very possible and I am guessing you plan to use some of the proceeds from the sale to do this. Well in practice, there is very little trust in the real estate business and to tell someone to pay first then you'll do the needful....well bottom line its very doable. The land has to be serious prime real estate sha and you may just need to do a little extra work in finding the right buyer.

Calm down. We're the seller. My dad is the heir, going by your submission. And you did not even respond to my question in the original post. You might want to read it again.

what do you mean by 'serious prime real estate' sir? Yes, we plan to use proceed from the sale.

Prime real estate means a very very very good location that will make a buyer not want to miss the opportunity to buy it and also make them take the risk of making advance payment to you. When they make the advance payment, then you can do the needful, they complete the payment when you have finished what you need to do

Definitely, as long as it is not contested by any of the concerned parties. I mean those that have a provable relationship with the writer of the will.

So yes, a will is a great instrument of conveying title across generations

Nothing like that, you're very very wrong.

This property is in Lagos and since there's no Will or Letter of Administration yet, it is governed by Yoruba inheritance law and customs which are the Idi-igi and Ori-ojori systems of distribution.

Nothing like first son or first grand son here.

If the late owner of the property died intestate (without a Will), they can't manufacture a Will from somewhere. Even if there is a Will, it must have been registered.

What they need to do is obtain a Letter of Administration over the property. Once done or while in the process, they can enter into negotiations with interested banks. However, they'll need a lawyer in their negotiations with the bank as well as processing the Letter of Administration.

They are recognized as having rights in inheritance but they don't have exclusive rights to inheritance.

It's not like when the father dies intestate (without a Will), all his properties automatically devolve upon his first son.
