Abuja Court Reaffirms Emenike As Abia APC Candidate by Ponponkon: 6:31am On Jan 18, 2019

UMUAHIA – A Federal Capital High, FCT, sitting at Kubwa, Abuja, presided by Justice K. N. Ogbonnaya has reaffirmed his order that Chief Ikechi Emenike is the authentic Abia State candidate of the ruling All Progressive Congress, APC.

Justice Ogbonnaya had on November 29th 2018 given the order that Emenike is the candidate of the party and directed INEC to publish his name as the candidate, which the commission failed to obey.

But Mr. Uche Ogar who was picked by the other faction of the party and the party, APC, approached the court and filed a motion praying the court for a stay of execution of the order and for the order to be vacated.



However ruling on the motion, Justice Ogbonnaya refused to grant the stay of execution motion and also refused to vacate the order reaffirming but rather reaffirmed her order as valid until it is set aside.

The issue of who is the authentic candidate of the party in the State has been lingering for long following an order secured from an Abia State High Court sitting at Okpuala Ngwa which recognized the state’s party exco that produced Emenike.

But the Oshiomaole led National exco recognized Chief Uche Ogar produced by the faction not favoured by the court order.

In her ruling, Justice Ogbonnaya refused to grant the request of both APC and Ogah’s motion for stay of execution of her earlier judgment which was in favor of the Emma Ndukwe led factional exco which produced Emenike as the governorship candidate of APC in Abia State.

Justice Ogbonnaya described the motion filed by Ogah and APC as “a clear abuse of judicial process, unmeritorious and un-grantable” and reaffirmed her judgment of 29th November 2018 as being valid until set aside.

Justice Ogbonnaya also condemned the action of APC and Independent National Electoral Commission (INEC) for not forwarding Emenike’s name as the authentic governorship candidate of the party in the State.

Justice Ogbonnaya further ruled that the 1st defendant [APC] has no discretion to refuse, reject and/or neglect to act on the list of candidates forwarded to it for onward transmission to the 2nd defendant (INEC).

She also ruled that the court which she presides has the territorial jurisdiction to entertain the matter that was brought before her.

The leadership the Emmanuel Ndukwe’s exco which produced has in the suit sought for the following reliefs from the FCT high court, to declare and reaffirm the leadership of Dr. Emmanuel Ndukwe as the authentic one in Abia state as ordered by Justice Collington Okoroafor.

*An order compelling the 1st defendant to forward the name of the plaintiff being the winner of the primary election as the governorship candidate of the APC in Abia state.

*An order compelling INEC to accept and list the name of the plaintiff being the winner of the governorship primaries conducted by the party on the 30th September, 2018 as the Abia state candidate of APC in the forth-coming governorship elections.

The party also sought an injunction restraining the defendants from through their officials, agents or servants from omitting, removing, swapping the name of the plaintiff.

Reacting to the judgment, Emenike commended the courage of the judgment in upholding the truth, saying that “it is the way it should go, as justice should be served, as the action of Adams Oshiomole the national chairman of APC is very condemnable”.

He said that he does not want to join issues with Oshiomole, as according “this is a man who is a beneficiary of the judiciary but like I said earlier I don’t want to join issues with him as I have respect for the office he occupies”.

VILLAGE PEOPLE ARE AFTER UCHE OGAH, AS ABUJA HIGH COURT THREW AWAY HIS APPLICATION, DESCRIBING IT AS UNGRANTABLE

The gubernatorial ambition of Uche Ogah is currently and precariously hanging in the balance as an Abuja High Court yesterday reaffirmed Chief Ikechi Emenike as the authentic candidate of the APC in Abia State.

Ruling on a motion filed by Ogah yesterday for a stay of execution of an earlier judgement and for an order of interlocutory injunction, Justice K N Ogbonnaya stated that the reliefs sought by Ogah are "a clear abuse of the judicial process, unmeritorious and ungrantable".

The Judge had on November 29, 2018 delivered judgment which reaffirmed the judgement of an Abia State High Court recognizing Dr. Emmanuel Ndukwe as the Abia State Chairman of the APC. Chief Ikechi Emenike emerged Candidate through the primaries conducted by the Ndukwe faction.

The Judge frowned at both INEC and the APC Leadership for failing to recognize Emenike and wondered why the duo do not want Emenike to enjoy the fruits of his judgement obtained from a court of competent jurisdiction.

With this ruling, what it means is that as at today, Uche Ogah is not running for any election in Abia State. In the eyes of the law, Uche Ogah does not exist as a candidate until the Court of Appeal rules otherwise.

When Uche Ogah goons were having uncontrolled erection about the hand over of flag to their man by Oshiomhole, I reminded them that once the issue of candidature of a party is before a court, it is the court and not the party that has the final say.

Instead of crying like babies, Uche Ogah and his people should quickly rush to the Court of Appeal to fight their battle, maka na oge adiro.

For us in the Abia PDP, we care less about whomsoever the APC presents as their candidate. Whether it's Uche Ogah or Ikechi Emenike, we are certain that Governor Okezie Ikpeazu will comprehensively defeat the person.

In the meantime, we sympathize with the Ogah faction over this potential judicial career ending tackle.

They can also pursue this matter spiritually because it is getting clearer that village people are involved in this. This thing is not ordinary.
I can recommend a powerful Prophet for them. His name is Hon Solomon S. Ogolo. He is very experienced in handling problems created by village people. He can assist them.

When an Uche Ogar supporter comes to you to pontificate about their man and his clean hands with respect to Abia Politics or to make negative comments about the PDP, please remind him of the following..

1. That Uche Ogah was a key stakeholder of the PDP in Abia State for over ten years.

2. That Uche Ogah personally nominated his biological brother to serve as Honorable Commissioner for Health under the administration of former Governor TA Orji. Ask him to show us how many hospitals that were built under his watch and the innovations he brought to bear in the Abia health sector.

3. That Uche Ogah and his company, Masters Energy were major suppliers of petroleum products to the Abia State Government for several years and that graphic details of all that transpired then are well documented.

4. That Uche Ogah desperately sought to be a PDP Governor. He took part in the primaries that produced the candidature of Governor Okezie Ikpeazu. He came second. He later sought to unseat Ikpeazu via the Courts by using a false allegation bothering on tax, even when payment of tax is not a condition for running for office of Governor under the Nigerian constitution. In any case, Ikpeazu couldn't have made tax returns that were false because as a public servant then, his tax returns were clear and verifiable.

5. Remind him how Uche Ogah sought to take over the government using an order of a Federal High Court.

6. That Uche Ogah took the entire State through a needless orgy of a protracted legal battle all the way to the Supreme Court seeking to be made Governor in an election he never took part in.

7. That it was after the Courts frustrated his plans to take over the state through the back door that he decided to abandon the PDP and move to the APC, a few months ago. Today, he speaks about the PDP as if he had nothing to do with the party.

Unknown to him, Governor Ikpeazu and the federal government have been collaborating to deliver power to Ariaria International Market. A brand new power plant is almost ready for commissioning at the market.

The Rural Electrification Agency of the Federal Government is handling this with the full collaboration and support of the Abia State Government.

Ariaria International Market is the only Market in the entire South East where this kind of project exists.

Otti and his goons are ignorant of developments like this one.

Today, development partners from within and outside the country are working closely with Ikpeazu in many areas.

Such things were unheard of before now.

It takes a leader that commands the confidence of the federal government and foreign agencies to attract these things.

Otti and his ghosts should take note!

Mr Don (maybe you're Don Ubani Maybe not) drop your car n take keke from Gate to somewhere like Ukaegu estate ( Ikpeazu community estate) then sample the opinion of people with you in that Keke, take the Keke back to gate then ask people there too, then you'll kn that Ogah stands a better chance of winning than OVI

On lighter note I love that OVI campaign song whoever composed and sang it deserve a reward.

All these OVI supporters, dancing around opposition cases show fear and panic. Ask them what Ikpeazu is campaigning with, they will say equity. Equity instead of performance, all MOUs this govt signed have been abandoned. A govt that can't boost of up to 20 completed road projects in Aba or Umuahia is seeking for reelection. I am still waiting for the commissioning of the osisioma flyover this January! Ask them to build road, they will say its Federal roads what of other roads that are not federal, they will say he has court cases. Osusu road is still a mess. Instead he is running from one church to another seeking for endorsement and giving away money like santa claus. May God help Abia State

this case is yet to get to appeal court and you're celebrating already. The party recognizes the faction that produced ogar, that's the ground here.

All Ogah needed was to run in PDP as governor in 2023 and he would have sailed to the government house smoothly.. Dunno if he was motivated by greed or his village people, now he is going to loose a second time and get very broke..

The truth is all this legal battle has no meaning, ikechi got a previous court judgement against Uche ogah..
Instead of him to go for judgement enforcement they proceeded to another court to get cheap judgement again.
The first judgement you got did not stop APC from submitting OGAH name as abia gubernatorial candidate so will this one ..
Ogah is our candidate and we are taking over 2019
