Tanko swearing-in Buhari after rigging will still amount to illegality by GenSpecifics: 9:37am On Jan 29, 2019 |
In the inevitable scenario that that the Supreme Court orders Buhari to reinstate Onnoghen as CJN to which we can easily predict Buhari will refuse to obey and Tanko continues to parade himself as the CJN, who will then swear-in Buhari as President after he rigs himself back to power? Will the oath of office taken by Buhari under Tanko be valid? I see more problems for Buhari and Tanko if they insist on this criminal breach of our constitution. 4 Likes |

My prediction is, the NJC wld recommend Onnoghen for suspension until he clears his name whilst recommending Tanko for compulsory retirement. It wld now recommend the most senior judge for appointment as Ag. CJN. 4 Likes |

helsinkiman: The NJC will require Onnoghen to be reinstated as CJN before he can be probed by said body. Since the NJC is solely responsible in carrying out disciplinary actions on members of the judiciary. With Onnoghen "suspended" as CJN, the NJC does no have the powers to adjudicate on the matters of a private individual since that is what Onnoghen is with Buhari's illegal suspension. So, that means, Onnoghen must be reinstated first and Tanko removed and sanctioned by same NJC before a probe by NJC can be carried out on Onnoghen. There can not be two individuals occupying the position of CJN, so Tanko must be removed. The biggest loser here is that Sharia judge, Tanko as he definitely will be sanctioned by the NJC for accepting to be acting CJN. 6 Likes 1 Share |

helsinkiman: Thank God you used the word "allegations". Onnoghen by his constitutional privileged status as CJN can only be probed by the NJC. His removal can only be started by an NJC recommendation to the Senate where impeachment process will commence and if found culpable by a super majority, his removal will need presidential ratification. After being impeached by the Senate and subsequently sacked by the President, Onnoghen can then face criminal trial before the CCT or any court of competent jurisdiction. This is what the constitution spelt out clearly in black and white. Why is Buhari so desperate in seeing Onnoghen's removal as CJN that he is ready to subvert the Judiciary and constitution is the question any sane person should be asking especially during this election period. 4 Likes |

Going by what you posted. PMB can't refuse to act as ordered my the Supreme Court. This matter purely concerns another arm of government and her leadership, the case of Magu and others can be distinguished and they can't apply here... If PMB dares disobey the backlash will be swift and severe. The world is watching!!! 3 Likes |

[s] helinues:[/s] Buhari took an oath to protect and uphold the constitution. With Onnoghen illegal removal and appointment of Tanko without NJC recommendation, Buhari has clearly subverted the constitution and ought to face impeachment by the Senate. This is why he has gathered the bokos and agberoes in the Senate to ensure that any motion to begin impeachment process is blocked. Your Buhari is now coming to the realization that he has really fcked up. By convening a meeting with APC senators where they were duly bribed, it is very clear that Buhari is very much afraid and not in anyway confident of where Onnoghen-gate will pan-out. The PDP will simply approach the Supreme court to clarify if Tanko's illegal appointment was valid and inline with constitutional provisions. The Supreme Court will declare Tanko's appointment as illegal and void citing that he was not recommended by the NJC and also that the real CJN was removed illegally. Onnoghen will be reinstated with Tanko sacked as CJN. The NJC will then rely on precedence to have Tanko penalized and forced into retirement thereby leading to Buhari and the APC losing their last legal life line. The events that will unfold in the coming days will not only shock Buhari but will ultimately see him losing out completely in the coming elections with no hope of judiciary backing of his rigging plans. You just watch and see. 2 Likes |

GenSpecifics: You don't understand how politics works. Do you think if Apc also have the 2/3 of the majority, Saraki will still be senate president? The NJC you are referring to are no different from regular Nigeria politicians. They have corpses not even skeletons in their cupboards. Same way Buhari is holding BDC Walter blokos, so shall he do same to any NJC members trying to be too smart. That's politics for you. Why did Pdp resumed campaign after suspending it initially? 2 Likes |
