How well do you understand land title documents necessary for real estate investment in Lagos and in Nigeria?

WHAT IS A SURVEY PLAN?
A Survey plan is a document that shows the boundary of a land. The survey plan gives a precise measurement and location properties of the land. A survey plan usually contains information like:
1. Name of land owner.
2. Land size, beacons and their numbers including the geographical address or description of the land.
3. An approval stamp showing the land is free from government acquisition.

WHAT IS GOVERNMENT EXCISION?
The Nigerian Land Use Decree of 1978 gives power over all lands in every state in Nigeria to the state governors. The Act gives the Governor overriding power to acquire more lands compulsorily for its own public purpose such as amenities for the citizenry.

It is therefore customary for state government to apportion some areas of land to the indigent owners and families (natives) of each area. This area apportioned by government to the natives or indigent families is said to have been EXCISED to the community, which the community can in turn sell to the public.
Note that if the land does not have Government Excision title, it means the land could be seized by the government anytime without compensation even if you bought it from the Baale of the land legitimately.

WHAT IS A GAZETTE?
A Gazette is simply an official government record book where all special details are written in clear terms for record purposes. The Gazette is well detailed and includes the history of every land in the state.

The Gazette shows the communities or land that have been granted EXCISION and the number of Acres or Hectares of land that the government has given to them.
The best way to know whether a land is under acquisition or has an excision covered by a Gazette is to get a Surveyor to chart the site and take it to the Surveyor general's office to do a land information to confirm whether it falls within the Gazette and spell out which particular location it can be found.

WHAT IS A DEED OF ASSIGNMENT?
This is simply an agreement that is done when an owner of a land sells his land to a buyer. The agreement is a legal document showing that a parcel of land has been sold to an individual or company. Such recorded Deed of Assignment come in form of either a Governor's Consent or Registered Conveyance.

WHAT IS A CERTIFICATE OF OCCUPANCY?
This document is fondly called C of O. This is the most popular document that the average Nigerian knows when it comes to land ownership or real estate dealings.
It is a certificate issued by the Lagos state govt that indicates that the state government has officially leased the Lagos land to you usually for a period of 99years.

WHAT IS A GOVERNOR'S CONSENT?
Governor's Consent is the approval that must be given by a Governor of a state or his delegates in any transaction that has to do with the transfer of ownership or other interest over land or landed property in order to make the transaction valid at law.
