If the judge orders that the second person takes his place on the poll (which is very unlikely given that the time for substitution has passed according to the electoral act) they wont have anyone's name to put.

I don't think there's any relevant law that suggests the deputy takes over.

Appears to be a lacuna in this area.

we are talking about a sworn affidavit here not a birth certificate and the problem seems to only be about the local government area not being in existence during the time of declaration. get a good lawyer and wike will end up with no case or delay the appeal process till after the election and even if he lose the case then, his deputy takes over the joint ticket and appoint another deputy
