Hi Nairalanders ,Please i really need clarification on this and I would be glad if there is anyone to help with a sincere answer.

A friend got a peice of land, 30 by 50 ft but when he gave the surveyor money to do survey,he discovered that the survey was backdated to 2001 which we find very strange but the man kept telling him there is no problem that they usually do it that way bla bla bla..Pls kindly advice on what to do and would such survey have red copy?? Thanks.

Although it's been a while since you asked this question, others might benefit from the answer.


HERE WE GO


The first question that should come to mind is,

"Why would anyone want to backdate a survey plan when he could use the right details?"

The answer ofcourse is, "It is cheaper than the authentic one."

Why is it cheaper?

"Because the surveyor did not lodge it at the office of the Surveyor-General of the state. Therefore, he did not pay the required fees."

Are there consequences for such actions?

Definitely yes, as listed below:


1. You can't get a red copy of that survey plan.

2. You can't tell if the land is under government acquisition.

3. If a dispute arises on the land, tendering that survey plan is like shooting yourself in the leg. Why? Because why it probably shows that you owned the land in 1921, other documents (e.g. Contract of Sale, Deed of Assignment, Agreement etc.) show you bought the piece of land (maybe) in 2021. How can you have a survey plan for a parcel of land in 1921 when you probably became the owner in 2021?

4. If the survey plan has a falsified date, other details (like coordinates, sizes etc.) on that survey plan might also be untrue.


IT IMPLIES THAT YOU CAN'T TRUST THAT SURVEY PLAN.


Get the surveyor to refund your money and get a registered surveyor to do the right thing. What is worth doing is worth doing well!
