I love your points OP, but you must understand that the line of senator Adeleke's victory is quite different from that of the ones you cited. Look at the constitution and you will know that there was no need for re-run with respect to Osun in the first place. This and others things were well argued out and same will play out and repeat itself even in the apex court when the time comes.

I was walking home from work when a friend called me with joyous tone that the tribunal has declared the pdp candidate for Osun Gubernatorial election winner. I asked what was the celebration all about he said he is now the governor na. I just called him "olodo and dropped the call.

Tribunal judgements since election cases gets to the Supreme Court has become mere academic exercise. After the 2015 governorship election, many candidates who lost the election went to court. Yours truly followed the cases of the then Rivers State Apc governorship candidate, Dr. Dakuku Adol Peterside and Taraba State governorship candidate of the Apc Mrs Aisha Alhassan, (Mama Taraba).

These candidates won at the tribunal and the court of appeal but lost at the apex court. So what's the celebration all about? Adeleke and the PDP should not celebrate yet until this matter gets to the Supreme Court.

And that is if Osun has any penny left in the ACCANT.

Adeleke will not rule until after supreme court. That is if the supreme court decides for him.

If apc had won at d tribunal I'm sur someone like u would have celebrated the victory forgetting court of appeal and the supreme court exists ... In life I have learnt to take one step at a time ... PDP - power to the people .... Any fellow that says PDP should not celebrate can locate the nearest pain river

MY TAKE ON OYETOLA DECISION TO APPROACH THE APPEAL COURT

I have this to say, we need to get things right, does anybody know the procedure of Appeal Court.

With my own little knowledge on the field legal, i believe Appeal is to cross the proceeding of the lower court, and fix out the wrong process done by the Tribunal.

Now, Oyetola and APC should remember that the INEC been the 1st defendant in the petition failed to defend the petition against them and they failed to file a no case submission as well, and while the 2nd and 3rd defendant (APC and Oyetola) also gave evidence contradiction in their defence and their evidence is not that tally with the evidence been presented by the petitioner.

During the proceeding of the tribunal, i make it known to my people that the outcome of the tribunal will be of two things, and in which the tribunal even make use of the two. I said it that, is either the tribunal illegalize the rerun and make use of the real election or ask the INEC to return the deducted votes of Adeleke/PDP, and at the end today, Tribunal said the rerun is illegal and ask INEC to return the votes.

Now, that APC/OYETOLA are step to challenge the Tribunal at the Appeal Court, they ask them it will be on what stand, claim or instant.

Let me ask again, what has been the INEC reaction/respond to the judgement given today, Don't be surprise if INEC fail to join the suit in Appeal Court.

I want to say this again, on what will the Appeal cross check the Tribunal proceeding.

It will be only result to suit after death.

In respond to the news going on now after the delivery of the judgement by the APC supporters that Wike loss in Tribunal, Appeal but receive his mandate in Supreme , i have this to say, let it be clear that Wike claims are different from Adeleke claims, the case are not of the same, and also does INEC failed to make case during Wike case like that of Adeleke.

I wish i post the full judgement of the then River State Election Tribunal so as for you to see the differences.

But you can do as well, check on google, by searching: *Judgement on River State Election Tribunal.*

Don't deceive people with that kind of hope.

Well one of the judges disagreed with you. More of them could also disagreed at the appeal or supreme Court.
Previous judgements that were later upturned at the upper courts were based on different perspectives, no one can conclude what judges will decide until they do

Whatever the supreme court decides on is what is in line with the rule of law and it's bound to be accepted. That's the reality. The winners will applaud the judgement while the losers will cry foul as usual.

Osun Tribunal Verdict: Adeleke’s Lawyers Move To Get Certificate Of Return.

Against the backdrop of Friday’s court judgement in Abuja by the election petition tribunal, which declared the Peoples Democratic Party (PDP) candidate, Senator Ademola Adeleke as the winner of September 22 governorship poll in Osun, the legal team of Adeleke has begun moves to get the certificate of return issued to its client.
Delivering its judgment, the tribunal had nullified the election that produced the All Progressives Congress (APC) candidate, Mr Gboyega Oyetola as the governor of Osun State and subsequently ordered the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Adeleke.
Findings by Tribune Online indicated that necessary arrangements were being made by Adeleke’s legal team to ensure that INEC complies with the court order with the service of the court order on the electoral umpire.
Speaking to our correspondent during a telephone chat, one of the lead counsels to Adeleke, Barrister Edmond Biriomoni said “right about now, INEC should have been served because the bailiff of the court or the tribunal had actually went to effect service of the tribunal’s judgment on INEC. We have already gotten the copy of the order and the bailiff had gone to serve them (INEC) officially.”
When asked about the plan by the APC and Oyetola to file an appeal against the judgment, he contended that “they are yet to file an appeal. They are yet to lodge a formal appeal. The appeal they are referring to is on the pages of newspapers or on their press release.
They have not filed a formal appeal at the tribunal. This is because I am just leaving the tribunal right now.”
Biriomoni continued “the order of the tribunal still subsist even when they go to the Court of Appeal except they set it aside. Until the Court of Appeal overrules the tribunal, the judgment subsist. Whether they file a notice or not, that does not take away the validity of the judgment until it is overruled by the appellant court, either the Court of Appeal or the Supreme Court.”
It would be recalled that the Osun election petition tribunal, sitting in Abuja had on Friday nullified the election of Oyetola as the governor of Osun State, cancelling results from 17 polling units over the alteration of results by INEC while it also deducted 2,029 votes of the APC and 1,246 votes of the PDP.
