Report: US Court Found Gbaja Guilty Of Withholding Client’s $25,000 In 2007 by EZENDIZUOGU(m): 1:50pm On Jun 06, 2019
Femi Gbajabiamila, majority leader of the house of representatives, was reportedly charged to court and found guilty of violating the rules of the bar of Georgia state in the US.

According to Sahara Reporters, Gbajabiamila, a lawyer, admitted to withholding $25,000 his client received as damages claims.

He was said to have been prosecuted before the Supreme Court of Georgia in February 2007.

The lawmaker, who is contesting for speaker of the house of representatives, has been recently accused of fraud.

His campaign organisation, however, denied the allegations on Wednesday. Abdulmumin Jibrin, his campaign spokesman, said the lawmaker has never been accused of corruption much less of being convicted anywhere in the world.

But Sahara Reporters has uploaded a copy of the judgement of the supreme court of Georgia, detailing Gbajabiamila’s case.

The judgement read: “This disciplinary matter is before the Court on the Respondent Femi Gbaja’s Petition for Voluntary Discipline which was filed under Bar Rule 4-227 (b) (2) before a formal complaint was issued. In his petition, Gbaja admits violating Rule 1 .l 5 ( l) of the Georgia Rules of Professional Conduct set forth in Bar Rule 4-102 (d). Although a violation of this rule is punishable by disbarment. Gbaja requests the imposition of a 24-month suspension. He agrees, however, to accepting a suspension of up to 36 months. The State Bar has no objection to the acceptance of Gbaja’s petition so long as the suspension is no less than 36 months in duration.

“Gbaja, who has only been a member of the Bar since 2001, admits that he accepted payment of $25,000 as settlement of a client’s personal injury claims, deposited those funds in his attorney trust account in January 2003, failed to promptly disburse those funds to his client withdrew those funds for his own use, closed his practice and moved out of the country. Although Gbaja ultimately paid the $25,000 to his client in 2006, he admits his conduct violated Rule HS (1) and that as a result, he is subject to disbarment. In mitigation of his actions, Gbaja asserts that he has cooperated fully with disciplinary authorities, repaid his client, and is extremely remorseful for the consequences of his conduct. Under these circumstances, we conclude that a 36-month suspension is an appropriate sanction. Accordingly, Gbaja hereby is suspended for a period of 36 months. He is reminded of his duties under Bar Rule 4-219(c).”

TheCable looked up Gbajabiamila’s profile on the website of the State Bar of Georgia where it was stated that he is under “administrative suspension (licence fees)”.

It stated that this means a “member who has not paid licence fees for a period of no less than one or greater than five consecutive bar years; is not eligible to practice law in Georgia, but eligible for reinstatement by specific steps mandated in bar rules, but will not be required to take bar exam to reinstate.”

I don't think anybody can argue this. When this case was first raised, his defendants in Nigeria said he is not the one the case is referring to. The question now is, why did he change from Gbaja to Gbajabiamila or vice versa?

Before anyone castigate this guy please try and read more about the person called Femi Gbajabiamila. He is a true leadership material, how i wish we have someone like him in every region not state just each region believe me lots of things would have been better by now. I don't know why all these ipob bloggers are too full of hatred; how many times do you want Gbaja to clear himself before these Igbos leave him alone? He denied on radio, paper and television, but yet majority of the threads castigating him are still from ipob terrorists. If you are not satisfied by his deniance, please show your face one on one with your evidences to open fresh case with him. Efcc is waiting for you to proof this case, stop hiding under keyboard. When did a disciplinary matter become a criminal matter?

This is another grasping at straws article. Nothing to prove Gbaja is gbajamialla, but more importantly, he was sanctioned, not jailed.

Not something to be proud of, but certainly not worth the noise being made.

This is not an ex convict.

Opposition have been raising the matter since 2011 and he has never denied being the person involved. If you can read and understand, you should be able to discern that the matter was simply that of a professional misconduct and not criminal in nature. There was no criminal conviction involved so what’s the noise all about? The matter had since been settled and his law practice license restored to him in the state of Georgia.

The current noise about the case is just an unnecessary distraction that will lead to nowhere.

He only denied being criminally convicted. He was found guilty of professional misconduct and not convicted for a crime. In Nigeria, criminal conviction is a ground for disqualifying a candidate from contesting. Being found guilty in a civil case is not a ground for disqualification.

1) gbaja was not convicted of any criminal offense
2)gbaja was guilty of professional misconduct and he effectively reported himself and negotiated his punishment.

If Femi Gbajabiamila is in US he will be e ligible to contest election and be voted for. He committed an offense, not a crime.

It is very bad of him to treat his client that way but if you read the summary it is unmistakable that this is violation of professional ethics.

We need to give it a statutory test. The offense happened in US. If it was felony he would have had a arrest warrant issued and he would be prosecuted. Moreover he would have lost his right to practice forever. However, thats not the case here....the man can reregister after paying member dues and resume practice. Felons cannot vote nor be voted in America. Femi has not failed the test of civil law, can vote and be voted for in America. Why can he not be voted here in Nigeria?
