The leadership tussle of IPAC, Ebonyi State Chapter, has taken a more frightening dimension as Green Party of Nigeria and Mrs Ebere Sam Udogu accused IPAC and Mrs. Jennifer Adibe Nwafor of forgery of IPAC Code of Conduct.

It was gathered that the plaintiffs had, on 22nd day of August, 2019, dragged Mrs. Adibe Nwafor , IPAC and three others to the Federal High Court in Abakaliki, seeking the following relief: 1, A declaration that the office of the chairman of Inter- Party Advisory Council, Ebonyi State Chapter, is vacant.

2, An order restraining the 3rd defendant from parading herself as the chairman of Inter- Party Advisory Council, Ebonyi State Chapter, having accepted a political appointment with the Government of Ebonyi State.

3, A declaration that all actions of the 3rd defendant as chairman of the 2nd defendant from the 14th day of November, 2018, when she took up an appointment with Ebonyi State government are null, void and of no effect.

4, An order compelling the 2nd and 3rd defendants to account for all monies received on behalf of the inter- party advisory council, Ebonyi State chapter.

5, An order compelling the 2nd and 3rd defendants to pay the plantiffs all monies due to them as members of 2nd planitif from 30th day of March 2019 till date, among other reliefs.

However (a), (b) of the plaintiffs prayers have been over taken by event by the IPAC election which took place in December, 2019.

In the suit no. FHC/AI/CS/40/2019, the 1st to 3rd defendants filed their respective defences, all bearing different versions of the IPAC Code of Conduct, 2019.

In their defence, the defendants, particularly 1, 2 and 3, denied the claims of the plaintiffs and asserted that (1) the court has no jurisdiction to entertain the matter because, IPAC is not juristic person. And also that a condition precedent as enshrined in a purported revised IPAC Code of Conduct, 2019, bordering on alternative dispute resolution, was not followed.

In view of the IPAC election, which held 2/12/2019, at INEC office in Abakaliki, the motion challenging the jurisdiction of the court was alleged to have been deliberately filed by the 1st-3rd defendants to arrest the proceedings of the court in order for the IPAC election to hold as the plaintiffs had gone to court seeking an interlocutory injunction restraining INEC from conducting/ supervising or using its office to conduct any election for the IPAC pending the determination of the suit.

On the 10th of February, 2020, 1st to 3rd defendants filed a further affidavit. In that affidavit, they annexed another IPAC revised code of conduct in Nigeria (2019).

Recall that this is the 3rd IPAC Code of Conduct in Nigeria (2019) the defendants is filling in the suit. The first Code of Conduct ended in page 40, the second code ended in page 38 while the 3rd ended in page 39 and a purported endorsement section of political parties tagged ” proposed revised Code of Conduct of political parties in Nigeria, 2019″ starting at page 44 and ending at page 51 allegedly signed by 82 political parties.

The alleged document prompted INEC to raise counter affidavit asserting that the said purported IPAC Code of Conduct 2019 and the proposed signatories do not exist. This assertion by INEC was in confirmation of an earlier claim by the plaintiffs that the document was fraudulent and forgery. The matter is adjourned to 2nd March for continuation of hearing in federal high under Justice Aluko.
