Wike has full rights.

Federal govt power ends in aviation while Wike is the Governor of Rivers state.

If we go by your logic of exclusive list and aviation the plane will remain in air and if it lands both the persenggers will remain in the airport. if they step foot outside the airport they are venturing into Wike Jurisdiction because he remains the Governor of Rivers State and land belongs to state government

These are nonsense 1999 constitution that is keeping this republic down
that's my problem with all these abokis , they too feel they have power over everything, the idiot may not even know what is in the Constitution, I watched him saying this trash on channelTV yesterday, I was like this country must go separate way now.

Mr. Aviation Minister, Wike has every right to protect the lives of Rivers State people. That is his primary responsibility.

If Sanwolu has been this proactive on time, Lagos State won't be in the mess it is today. You cannot stay in Abuja and be constituting nuisance to people in their states.

Why did caverton helicopter not release the flight.manifest of it's passengers for tracing?

Shouldn't the Federal government has made efforts to check, test and quarentine those passengers when they landed in Rivers State?

What measures has the Federal government put in place to ensure that the virus is not spread across Rivers state via it's points of entry?

Do they expect the governor to fold it's arm and watch while they bring disaster to his door step?

Never, I trust Wike, he's not going to let that happen. He has a responsibility to protect the lives of Rivers State people and he won't dull in doing that like those in ASO ROCK.

Let us assume I am wrong does that give you the right to ask if I am OK?

Go and learn some manners
This is not a legislation matter

Exclusive list is about separation between the NATIONAL ASSEMBLY and the STATE HOUSE OF ASSEMBLY

The issue is in court they were charged with alleged offences which are not aviation matters
Now that the matter is in court they can put up a defence.

People just parrot exclusive list without understanding of what it means
So the moment a helicopter is involved ut becomes "exclusive list" matter.
Arms and ammunition are on the exclusive list

So by your reasoning any offence involving guns is an exclusive list matter and state governments cannot act?
you are doing well!! God bless you real Good exclusive my foot that's one reason we are backward in everything

He is the Governor of The State. He has SPECIFIC AND GENERAL POWERS TO CONTROL THE STATE. MR. PRESIDENT ONLY HAS GENERAL POWERS.

MR. PRESIDENT CANNOT AUTHORIZE THE INVASION OF A CONSTITUTIONAL STATE WITHOUT THE ACQUIESCENCE OF THE STATE GOVERNMENT.
Re: Hadi Sirika: Wike Has No Right To Order Arrest Of Pilots by stepone(m): 7:39am On Apr 09, 2020
So you mean state gov have power within federal airport premises? The power of a state governor ends within the airport and can also be arrested within the airport and be transported by air to FCT. Wikes arrest does not follow due process. The federal airport is a federal gov premises and property (on land and in the air).

proxillin:
I have been reading stupid comments here.

The federal government can grant the permit for plane to fly.

Then the plane should not land, it should be on air perpetually. Wike has no power to touch the plane in the air.

But the moment the plane land, and the pilot walk and violate the state lockdown/curfew, thats Wike's power.

Lets educate you the more.

If there is curfew in Lagos and you boarded a bus from osun. You are free to pass Lagos-Ibadan express way. But the moment you get to berger, you have no excuse to disobey lagos lockdown rule.

EHN Osun is not under lock, Lagos-Ibadan is a federal road that is not under lock. But berger where you land is lagos land which is under lock.

Sanwo Olu don catch you be that. Anything you get from there you should endure it. Its not osun or Federal government jurisdiction to force Lagos to allow anyone walk around,

0m0nnakoda:

You lack understanding of two things

1. Exclusive list is an EXCLUSIVE LEGISLATIVE LIST about Legislation. The NATIONAL ASSEMBLY can legislate exclusively on those matters.
It is not about TAKING DECISIONS as you erroneously claim

2. The issue on ground is not an aviation issue if a pilot brings drugs ,or guns into Rivers state is that an aviation matter? If he uses his helicopter to kill people is that an aviation matter?

The flight manifest must be provided to enable contact tracing as a matter of public safety what is exclusive about that

On the second point you made, the minister said the company got clearance from FG to fly into Rivers state since aviation is on the exclusive list and the FG holds power over that.

Unfortunately there is nothing Buhari can do about this. At most the Aviation ministry will only make appeals for the company.

Wike remains the chief security officer of Rivers state. Every other thing is Secondary.

This matter is very simple, Wike should know the boundaries of his power. What we should try to understand is, if Wike arrested the pilots (that got FAAN clearnace to land )on the premises of the Airport or arrested them when they got outside of the airport? If he arrested them in the premises of the Airport, then Wike is just a fool because he doesnt have powers on FG property like the airforce base or Airport. But if he did on the road outside of the airport, then he has all right to arrest them. The Company that owns the Helicopter ought to have sent a letter to the Governor informing them of the official duty given to them by the FG, so the pilots can be allowed to move on the streets of Rivers State.

On the contrary, the State Government has to have a seamless intelligence at the airport to be notified on very important fleets that must come in. Then you send all that arrive on board TO AN ISOLATION CENTRE FOR 14 DAYS and when they are cleared, you let them return to their houses.

Can he stop Buhari from coming into Rivers Think about this. Politics is getting the best out of Nigeria and Rivers State is bearing the brunch. After Wike, Rivers State will still be suffering, paying for the irresponsibilities of her past leaders. Smh.

Do we need this power show now when lives are at risk?
This is a failure of leadership from Buhari.
The fact that Sirika is the one speaking persuades me he,Sirika, authorised this

The question is does the aviation minister have the power to authorise a civilian aircraft to land in a military airport bypassing military hierarchy and the president. Now that Kyari is unwell do ministers have access to the president
The presidency is the one playing politics. They coordinated with Lagos state. Why couldn't they carry Wke along?
I very much suspect that if the flight manifest is produced we would discover that the aircraft did not have the correct authority to land at the airforce base.

Compliant while agreeing with you regarding the powers conferred on the central Government, we must not be oblivious to the fact that we run a Federal System and we are in an emergency where the head of the federating States take decision to safeguard the populace from harm, moreso the Governor came out to warn that after the lockdown nobody will be allowed into the State, knowing fully well he cannot stop the airports from functioning he said those who come in through airport would not be allowed to access the city, I really don't see what is amiss here that the Federal Government is creating a mountain out of a mole hill. On the hand why did not go entry points to the various States and allow those who were stop from entering the various cities. My Broda this is a pandemic and a lockdown pressupposes both social and economic.

What are you saying.

Hit the nail on the head.

The Federal controls FAAN.

Take that to the bank.

The president can day all prisoners be released. The police and military are under Federal.

This common sense and shouldn't be a debate

You need some education.

The president does not control the courts. There is separation of power between the legislative arm, judiciary and executive.

The pilots flew into Rivers State. If they stayed within the airport, that is not problem. But, when the passengers step into the streets of Rivers State when their is a restriction order, that is an offence against the state.

The pilots have been taken to court and remanded in custody. The federal government AMD company van send their lawyers to defend them. At the end of the day, justice will be done by the courts.

The government need to respect constituted authority. The minister of aviation need to be properly educated. Aviation is on exclusive list but driving on the street of Rivers State is on residual list. And the pilots brought passengers who went of exclusive jurisdiction into residual jurisdiction.
