Deceive yourself

Is freehold in the Nigerian constitution.?
*Smart clauses" to keep you happy and deluded
When the time comes you will be shown historical clauses ,if you are still around.
In Lagos State you hold land under native law or at the pleasure of the governors.
The only exception is the former FCT of the Colony I.e Ikoyi ,VI and some parts ,not all, of Lagos Island
You cannot acquire what the giver cannot give

Ancestral land is held in Trust. It cannot be sold. It can only be leased.

Is there any clause telling you you bought land for eternity or in perpetuity?
Is their any clause conferring rights to minerals lying under the land?
You are deceiving yourself.

Ancestral land is not subject to inheritance tax. Any other land you can be taxed on when you sell at a profit or try to will o to your descendants
There are so many ways we can deal with you If you are external so don't gloat
Most of the houses in Lagos are built on land designated AGRICULTURAL use only.
Government turns a blind eye but the planning code has not changed.
That means your mansion can be demolished without warning afterwards it remains yours if they don't fine you and ask you to pay for demolition but you can only use it for cassava so don't celebrate too soon.

Just be quiet and humble

You can embolden your hopes any way you deem fit. The bottom line is that the doctrine of freedom of contract encompasses all the jaundiced, primitive phrases you're banking on.

The last time I checked, Nigeria is still a common law country and the system of laissez-faire still applies as per how individuals chooses whom and how to contract. The judges' construction in this regard wouldn't be anything unusual. My little friend, don't wallow in ignorance.

Good that you want to learn. In a nutshell, the Common Law legal system has its origins in the UK. It dates back to when King Henry II initiated the idea of a similar and unified legal system throughout his kingdom. Hence, the birth of the phrase "Common law".

Omonakooda, the system of "Common Law" is rooted in the doctrine of precedent, stare decisis and hierarchy. This means that the lower and inferior courts have to abide with the ruling of the superior courts. Excluding obiter dictum; obiter is a side statement. Nigeria and Engish cases are still cited in court rooms in both countries.

Thus, Nigeria's legal system is chiefly grounded in this system in addition to Sharia and Customary laws. Coming back to the discussion, contracts are integral part of the Common Law system. And the principles of the law of contract still applies to individuals who chooses to enter into a contractual relationship.

Do not be silly .

It should have been obvious to you fro thenget go,if you have any sense ,that I was challenging your claim.

We were talking about land, within the context of freehold and native law.

Where does common law come into any of that.

You just threw it in to appear knowledgeable when in fact you are an empty vessel

You claimed Nigeria is a common law country

What the hell is a common law country?

What has common law got to do with what we were discussing?
In Nigeria Native law over land holding is the supreme title where proven. It cannot be revoked and land held under Native law can only be acquired in the public interest.

I believe you've now been educated on Common Law regardless of your stupidity.

How do one conclude a land transaction with a title holder in Nigeria? It's obvious you're irredeemable.

Come on, I urge all Igbos and every other person buying land to:

I) negotiate with the proper title holder/holders.

2) bargain which ever way you deem suitable. If agreed by the other party, draw the contract. If you offer more money for a freehold, and the other party agrees. Go for it! If the other party insists on a reversionary lease, accept it but don't agree to a "surrender" clause to your building/buildings. There are legal phrases to compel both parties to renewal after reversion. Negotiate it. You have freedom of contract.

First let us agree that it has nothing to do with Common law

Second you are assuming that FREEHOLD as you conceive it exists in Nigerian law. It is an abstract legal concept

What is its statutory or constitutional underpinning in Nigeria

If you "buy" land held under native law. You are merely leasing it from those who hold it in Trust for their bloodline
They cannot sell what they don't own. They are merely caretakers of the land no matter what the conveyance deed says.
You are just another caretaker for their descendants, omoonile or autochthons.
If you convert your title to a Cof O you become a tenant of the state government for 99 years.
By the time the legal argument takes place none of the actors would be around

I foresee the pipeline being sabotaged soon.

Unless the gas is also used for the development of industrial cities in the East. So that everyone benefits. But to use Igbo resources exclusively for the development of Lagos state is definitely going to fail.

No. The Common Law underpins the main body of the Nigerian legal system, viz, the criminal law, law of evidence, tort law, commercial law, public law etc. These laws operate within the principles of the Common Law.

Your favourite, the Customary law, is an indigenous system by its provisions, but however operates within the frame work of the main legal system of the country which is the CL. For example, the Nigerian constitution did not create any other superior court to entertain a highly disputed land case other than the usual High courts, Appeal courts and the Supreme court.

Again, native law does not forbid the concept of freehold just as it does not forbid leasehold. Regardless of the Land Use Act 1978, show me anywhere such is forbidden in the statute books?

I repeat, any land-owning family or their heirs has the legal right to do what pleases them with their land.

If I have Shola as a friend and he wishes to settle in my village in Anambra and wants a land. And he requests that the land be made freehold. And the family agrees, there is no law that forbids my family not to honour his request in a contract.

And once done, it is permanently his land, especially when a consideration is involved. This is where the freedom of contract or the Common Law comes in amidst customary law.

You keep parroting Common Law just exposing your ignorance of what it means

Native law in Nigeria is part of Nigerian Common law
Common law simply refers to judgments that have been made .
So for example it has been established in the courts that in Yorubaland under Native Law wives cannot inherit property of husbands who die intestate.particularly land
Once that precedent is established it becomes "common law"

You are free to repeat whatever you like it is your mouth
It changes nothing
I don't know anything about land in Anambra . It is irrelevant

We are talking about Lagos which is Yorubaland
Native law title is the highest title in Yoruba land higher than a C of O

Families hold land IN TRUST for Omoonile. They cannot issue freeholds. Any deed that issues such is void to that extent.

Parents have custody and parental responsibility of their children they cannot sell them .
They can put them up for adoption but even that has a life time
Nigerian government can sell land in Abuja to the US government. That does not make it part of the US

Refer to your earlier questions and misgivings. I am happy you now have a little idea of what is CL after having schooled you. After disparaging the presence of CL in the Nigerian legal system. Learning by tricks won't help you. Such a primitive mind. Idioots everywhere. Ugly Yoruba man.

Lalasticlala, in this thread, the real anambra first son specifically mentioned you that the fake one cloned his moniker.

There was one where the real anambra first son moniker said maybe the mods have banned the fake one that's why he don't see him around any more.

Check among the two who just finished serving a long ban for clue.
Also the real one has been here since 2015.
I bookmarked his profile so I knew. Check his posts, since 2015. As I complained, the fake one hastily changed the date registered and also changed the monikers.
But the tones are very different. Writing different.

Check his exchange with the real one and you will know.

Do you see females on politics section anymore?
How many females are active on nairaland?
They are not up to 200.

I belong to a forum called soompi. They are centuries ahead of nairaland I can't catch up.
The moderators are very strict. Try register there and see if nairaland can copy their format. It's more like nairaland than quora or reddit.

It's an international forum a product of South Korea so they should be ahead in IT. Has millions of followers worldwide so you should understand what I mean.

I just want at least one good thing I can be proud of about my country.
Can't even show this to my friends who want to know more about Nigeria.
