Section 133 (3) of Electoral Act mandates that election petition tribunals shall be constituted not later than 14 days before an election is held.
This was done in line with the law by the former CoA President

Section 258 (6) of the Constitution reads "An Election Tribunal shall deliver its judgment in writing within 180 days from the date of the filing of the petition". Any judgment of an Election Petition Tribunal delivered outside 180 days of filing of the petition will be null and void.

When did they file this petition?

This issue, I think, is outside the jurisdiction of the Election Petitions Tribunal.

It should have gone to a Regular Court.

Please sir for the last time,don't bring up uche nwosu case again.. Aside that,you are analysing from a wrong angle or standpoint.your analysis has been overtaken by new events.we should be looking forward and asking if apc will participate in the new polls or not and if apc does not participate,will the participating parties be allowed to do fresh primaries and substitution in the event that the supreme court upholds this ruling?

But regarding your analysis,various supreme court rulings recently has made almost all pre election matters to be under the jurisdiction of election tribunals.mind you there are precedents..
Secondly,the declaration of pdp as winner front dated all petitions filed prior to that judgment.automatically,that petition will be calculates as being filed within 21 days after the certificate of return was issued.arguing otherwise will be saying that pdp petition that was filed when Lyon was declared winner is still alive

I see no reason why APC will not participate in the fresh election if Parties are allowed to conduct fresh primaries.

This is a welcome development. Hopefully, the good people of Bayelsa will have another opportunity to elect a governor of their choice. The supreme court governor that currently rule the state is not the choice of the people. He is an impostor who was never voted for by the people. He should pack his load and go and allow the people to make a fresh choice.

We need to be sure that apc can contest.did the supreme court ruling affect apc primaries? Is it a fresh elections or just a rescheduled elections? We need to hear clearly from inec.are parties allowed to re do their primaries? Is the fresh elections akin to a bye election?

That means issue of qualifications is not a post election issue considering that it usually happens after qualification issues arises

I have read with utmost regret that some of us still doesn't understand politics and the judiciary processes. The tribunal sitting in Bayelsa gave verdict on 3 petitions before them on Saturday and that doesn't mean that's the only petition on their table, they have many so they take it one after the other. The supreme Court judgement was a pre-election case and can't stop the tribunal from sitting. Gov. Diri still remains the Governor until he exhaust all judicial alternative at his disposal

If ANDP is to participate in the fresh election it means they would conduct primaries to be able to field a candidate and this is a process of its own.

So if they are allowed to conduct primaries it simply follows that every other party will conduct fresh primaries.

I will agree with you tentatively.again anytime the court or electoral act uses 90 days for elections to be conducted,it means total or fresh elections.if it is 30 days,it means a recintinuatiin or a supplementary polls.we can safely say that APC will participate

How can you also legally prove your case of unlawful exclusion when elections have not taken place? It is only when the election holds and you are not part of it that you have a ground to appeal.

Unlawful exclusion of any form including party logo can be challenged only after elections.
