People In the house, especially lagos lawyer I need your help.
My brother issue quit notice to one of his tenant. The notice was issued six month to his yearly expiration which expired on the 31/12)2020.
The tenant is saying that the notice is suppose to be after the expiration of his yearly rent which I tink is not true.
My brother went to the human rights for the issue.
Please did my brother issue the notice on the right time ? And what should he do?
Please the house is in Lagos .

Your brother issued quick note at wrong time...im afraid to say your brother will go to jail if care not taking with just new law guides the landlords and tenants in Lagos.

Go to the rent control court or use a barrister. Notice is meant to prompt the tenant so he/she can plan ahead. It can be served even while the rent is runing. When notices are served at the expiration of rent, tenants are expected to pay for the period of time which the notice runs. Unfortunate it's been misconceived that tenants are to occupy the apartment for free. this is why most of them assume that quit notices are to be served at the expiration of the subsisting rent
