I am quite sure he did not think about the attendant consequences of his actions before leaving for Lekki that fateful morning. We get so frustrated at times, that we don't sit to count the cost before doing an act.

At other times, we get influenced by social media that we end up taking actions that might cause us legal problems.

It was a quiet Thursday morning. It rained all night and leaving for Igbosere that wet morning was quite hectic. The flood had covered a huge chunk of the road.

The early morning rains made it worse, as the potholes now permanently hold crusade on the ever-busy Lagos roads. Well! They are all out to win souls. Nor be the koko be that!

It was not the usual traffic that morning, this was 'go slow'. As soon as I stepped into the courtroom, it was pretty clear that the court will not sit early. The court finally sat at about 10 am.

A quick perusal at the court’s docket revealed that a majority of the cases was slated for trial. Thus, making me wonder if I was going to end up spending the entire day in court.

The day was moving quite slow, with some counsel nodding their heads like the proverbial Agama lizard. The court suddenly woke from her slumber, as soon as the registrar called this case.

And the Landlord, who was the witness for the day kept murmuring “ omo Igbo ni ooo”. I suppose his anger was that his tenant who could not pay rent, had the temerity to bring him to court.

The judge observed him for a moment, whilst his counsel kept apologizing to the court on behalf of his client. During examination in chief and cross-examination, there was no denial that the Claimant was a tenant of the Defendant.

The tenant sued his Landlord for trespass.

Can a tenant sue his Landlord for trespass?

Generally, the answer is “No”

But what happened in this case and why was judgment entered in his favour against the Landlord?

Which provision of the law did the court activate?

Kindly educate my ignorance. Me self wan go read book.

Landlord can tresspass , if u rent a room , and landlord break into the room without your notice , it's tresspass , upon it's in his property

You're right. That is why most educated Landlords go to court and get eviction notice, with a bailiff and do the needful.
