Plus you are sure that the family that you are buying from has sold to other people who have perfected their title.

The writer of the above only succeeded in causing confusion. I guess you are not a lawyer, pls leave legal issues for lawyers to handle.

Deed of Assignment: This is a document that transfers ownership in a land from the seller to the buyer. It is compulsory that all landed transaction must be in writing but where same is not reduced to writing, you must have people who witnessed the transaction. To avoid confusion and future loss, it is better to have Deed of Assignment.

Certificate of Occupancy: This is the document issued by the governor of the State where the land is located (as you know all land belongs to the Governor of a State who holds it in trust for the people of the State). It is not conclusive evidence that the land belongs to you but it adds value to the land. You need to have Deed of Assignment to process Certificate of Occupancy (c of o) (and the Omo-onile receipt for those in Lagos).

Survey Plan: This is a document that only measures the land but also help to locate where a land is lying in case the owner is not sure or where two people are claiming one land, then a composite plan could be done to determine who actually owns the land. In Law, survey plan is not a title (legal) document because anybody can go to a land at any time to survey it. I therefore advice when you buy a land, the first thing to do is do a Deed of Assignment upon payment, then erect beacon/corner piece on the land or better still do foundation to secure the land.

Right of Occupancy: This is nearly the same with C of O but it is usually being issued by local govt or government agencies dealing with govt land e.g. LSDPC, LBIC in lagos but is inferior to c of o.

Gazzette: This is a document issued by the State government acquiring or releasing a land (depending on the circumstance). If govt compulsorily acquire a particular area and later release the land back to the cimmunity a gazzette must be issue by the govt to that effect. The gazzete will form part of the Title to that land. Once a land has gazzette, you dont need to do c of o but to do Ratification.

Ratification: Gazzette leads to Ratification. Ratification is another form of title and is stronger than C of O.

Governor's Consent: Title is not a document but a Title. It is similar to C of O and Ratification. To do consent, you need to buy a land that already has certificate of occupancy. Once the land has c of o, you will need to apply for Governor's consent with the Deed of Assignment document executed between you and the seller.

all my lands are in form of deed of agreement. after which I did corner piece before fencing when I av extra cash. it isn't easy fencing acres of land.

Global c of o is for a group of land in the same place not just a single land. For example, an estate will have a global c of o and not c of o for each flat in the estate. If you need land in Ilorin and you want someone to do something leg work for you, contact me.

Power of Attorney: This is a document giving by someone to another person to carry out some function on his/her behalf. In law, Power of Attorney is not a title document and is NOT a valid document to transfer land (although this is commonly use in the South East but is not recognise in law and thereby is invalid). Power of Attorney can only be a document or tool that could lead to sale or transfer of land but itself cannot transfer land. Insist on Deed of Assignment to be executed before you pay. Get a lawyer to undertake due diligence on your behalf and prepare the document before you pay.


Global C of O.: In law there is nothing like global c of o. C of O is c of o. Global c of o is generally use to mean mass land that is cover by a single c of o. Since the mass land belongs to one particular person who must have applied to govt for c of o, the govt will only issue one c of o to that effect. If you buy such land the owner will only give you a photocopy of such but you can use it to process your Governor's consent but you will need Deed of Assignment and, survey plan.

Certificate of Occupancy
A certificate of occupancy is a proof of land ownership given to a land owner by the Government. A certificate of occupancy is a document issued by a local government agency or building department certifying a building’s compliance with applicable building codes and other laws, and indicating it to be in a condition suitable for occupancy.


Deed of Assignment
The Deed of Assignment acts a main document between the buyer and seller to show proof of ownership in favour of the seller. A Deed of Assignment is an instrument of transfer used in real estate transactions to transfer legal title or the ownership in a land or building from the title holder (called the assignor) to another called the assignee usually for a consideration (money or money’s worth).


Gazette
The Gazette is an Official Government Record book of all URBAN land within a state. Gazette provides a permanent official public record of important statutory and non-statutory notices that can be used to support legal and other processes, and act as a means of advertising public notices. This is a document that records and expresses the areas the government has given to the family and community to acquire and that the government won’t secure it for any reason with the exception of an appropriate information.


Survey Plan
A Survey Plan is a document that measures the boundary of a parcel of land to give an accurate measurement and description of that land. The people that handle survey issues are Surveyors and they are regulated by the office of the Surveyor general in Lagos as it relates to survey issues in Lagos.


Governor’s Consent
A land transaction is only deemed legal in the eyes of the law when the buyer obtains Governor’s Consent i.e. if the buyer is not the first owner of the land. The Governor’s Consent is the approval that must be given by a governor of a state or his delegate in any transaction that has to do with the transfer of ownership or other interests over land or landed property in order to make the transaction valid at law.

The definition given to the c of o above needed correction. We have statutory and customary right of occupancy according to the land use act of 1978. The State Military Governors issues Statutory Right of Occupancy which is now from the the Governor of the State. Customary is for rural area and issued by Chairmen saddled with the responsibility.
I Ogun State the certificate of Occupancy is from the Governor. We have two processes which is ratification c of o and Direct c of o for (Private land).

if you have your c of o you are automatically saved from land grabbers. But if you have land fence it round without running of survey or do c of o on it, that might cause litigation problem bks it might be sold to somebody else.
If you have survey plan that is registered survey, a wise person that want to buy land will first go for charting. The charting report will reveal the owner of the property. If the buyer has the original receipt from the same people that sold it to you to you and he has process hos c of o before you. That c of o made him automatically the owner of the property.

Please OP @cotenantNIG I have two questions:

1- You seem to have given two definitions for C of O. Th first states that it's a document given by government to show that a particular citizen can use the land.
But the second states that it's a document to show that the structure on a piece of land conforms with building and town planning codes.

Firstly, I'm unable to reconcile the two definitions.
Secondly, from the little I know, the first definition is the correct definition of Cof O. The second definition seems to be the definition of a building plan which town planners request for.

Am I missing something?

2- What's the difference between governor's consent and deed of assignment? Or, better put, what kind of land transaction requires DoA and what type requires GC?

Let me help out a little way. Consent mean is done when there is existing title of ownership on any property and you bought it. Two c of o can not come out on same land you have to perfect your own title document by doing consent. Meaning seeking of Governors consent on alienation of any property. You can not sell any property with existing title without it.
Deed of assignment is the one you do when you bought property from vendors, it is contain all details of the sellers, buyers, witness and secretary. That is an instrument to use while processing your own certificate. It is different from land receipt because it is bulky and contains full information relating to the said property. Lawyers signs the deed of assignmentt or deed of agreement after the family.unlike receipt
