Court Asked To Stop Igp Adamu From Remaining In Office by garfield1: 4:17pm On Feb 04, 2021
lawyer has filed a suit at the Federal High Court in Abuja to stop Mohammed Adamu from continuing to functioning as the Inspector General of Police (IGP) after attaining the maximum 35 years of service on February 1.

Maxwell Okpara, in his suit filed on Wednesday, wants the court to compel President Muhammadu Buhari and the Nigeria Police Council (NPC) to immediately name Mr Adamu’s replacement.

The President, Mr Adamu, the Attorney-General of the Federation, and the Nigeria Police Council (NPC) are the four defendants sued by the plaintiff in the suit challenging the validity of Mr Adamu remaining in office after February 1.

Mr Adamu, 59, who joined the police force on February 1, 1986, has remained in office after he attained the maximum service period of 35 years.

Suit
Mr Okpara asked the court to determine if, by virtue of section 215 of the Nigerian Constitution and section 7 of the Nigeria Police Act, 2020, Mr Adamu could “validly continue to function as the Inspector General of Police not being a serving member of the Nigeria Police Force as from midnight of February 1, 2021.”

Citing the same constitutional and statutory provisions, Mr Okpara also asked the court to determine if “the failure” of President Buhari and the NPC to appoint the new IGP since February 1 “does not constitute abdication of their duties.”

In his prayers, he asked the court to declare that Mr Adamu “cannot lawfully continue to function as the Inspector-General of Police” and that “all actions” taken by him thereafter “are illegal, null, void and constitute a breach of the constitution of the Federal Republic of Nigeria and the Nigeria Police Act”.

Why IGP Adamu cannot leave office-

The decision of the President to extend the IGP’s tenure for another three months was to give time for proper selection of the new helmsman.

This position for now is too sensitive to rush into conclusion.

All the serving DIG and AIG are all qualified to replace IGP Adamu.

Let's give the NPC time to make a very careful selection of who will be our next IGP.

Granted?

The Court is to interprete, the Executive is to execute....if the man doesn't execute what will happen?

NOTHING.

PS: Obviously, the Police Act won't be followed anymore.

Are you saying that they didn't know he was quitting three months before now?

No respect for set rules
No respect for the Constitution.

How can you extend the tenure of someone who's suppose to have retired

Does it mean that there are no capable hands in the Force that can replace him or perhaps Buhari is yet to decide which Northerner he will replace him with.

How can a sensible government extend the tenure of someone who has retired, maybe Buhari has one last evil assignment for him, as usual.

All these while the mannequin and those in his walking dead cabinet couldn't strategize and decide who to replace Adamu even when they knew he would soon retire, well why am I surprised, we should not expect anything more from a President that took Six months to fix his cabinet

All these developments have continued to affirmed that Buhari is the most lawless president ever seen in the annals of this nation or someone else is indeed occupying Aso Rock

So the government is so clueless, or as usual unaware, shocked, or surprised that an IGP will one day retire or become incapacitated to remain in that position hence a contingency plan put in place in condition of service?

The president violated the PSC provisions of the Police Act 2020 that he himself signed into law, which in Section 7 (6) fixes a single term of four years without an option of extension of tenure for the holder of the office of the Inspector-General of Police.

“A person appointed to the office of the Inspector-General of Police shall hold office for four years,” Section 18 ( of the Act signed by the President on September 15, 2020 also read, “Every police officer shall, on recruitment or appointment, serve in the police force for 35 years or until he attains the age of 60 years, whichever is earlier.

See how you are thinking and I guess you are educated.
So you mean all these while arrangements were not made for who to replace Adamu, the mannequin had to wait till he retired before extending his tenure and begin to hunt for a replacement.

When you reason like this you make non Nigerians who might be on this forum to think that all of us in this Country don't have sense, they won't know that it is only a few of you zombies that are dim and always think like Ozuor.
