Good day Nairalanders, I'm an interior/exterior designer I have a company name not properly registered with CAC.
Some weeks ago a Chinese mailed me that a name similar to mine is about being trademarked in Asia.
That I should ignore if I'm not interested or I should reply him.
Now I have dreams of making the company a global brand so i showed my friend the mail he said I should wait after the name has been trademarked I sue the company they'll pay damages and I'll be super rich.
Please legal practitioners help me, is this stolen intellectual property?
Can I win the case from Nigeria?

Legally speaking you have no locus standi to sue anyone since you have not even done basic company name registration with the name.

Technically speaking a trademark belongs to the first person to actually register it the fact that you have been using it for the past donkey years does not cure your defective title in the trademark.

My advise would be for you to hurry and do the company name registration so you can at least have a leg to stand on!

You have nothing to be scared of. It's pure scam. Just leave these people, I get tons of this mail every week.
Move on with your registration and start your business.
