A woman was accused of killing her husband, his body was never found and she was sentenced. Years after serving her jail term, she found out the man is living with another woman.

She went and shot the man several times and he died for real this time around and she was re-arrested for the same murder on the same person.

As a judge what will you do ?. will you look at the case as a fresh murder or will you look at it as a crime she already served the term?

It's almost impossible for a court to sentence one for murder when the murdered is still alive. Circumstantial evidence must have convinced the jury that the 'deceased' was actually killed and is dead. Without enough circumstantial evidence, the accused can only be detained, but not sentenced.

But if it does happen the way you said, she will be charged for illegal possession and usage of arm, and not for a murder whose term she has served.

To add to my view, if I were to be the woman's attorney, my line of argument would be that you cannot kill a dead person.

What jail term did she serve exactly? In my opinion, since it was a murder case, she should still be in jail, and the poor man would still be enjoying himself outside. Make dem go arrest who release her in the first place.

Justice system does not base on emotions or natural instincts, it based on country lay down rules ( constitution). Judges only interpret what is in this rule or constitution.

If i am to judge this in my own natural way, the woman would still be punish for the same crime, because she failed to do the right thing by reporting him to authority.
