I created a thread a while ago that a company didn't accept my resignation. See initial thread

In that thread, I wrote about how I dropped resignation letter but the company kept mum until I left without making plans for handing over. I said that their 5k was left with me which they didn't say anything about and that my pension was never remitted. Now I don't care about the pension but I think they are trying to set me up.

Their 5k was initially left with me but they still sent the following month estacode to me, after I had left the company. I contacted the accountant that their 5k was left with me and they still sent a new month estacode of 10k to me. I asked him to provide the company's account number and I sent the money to the account which the company confirmed. They said nothing about pension but I don't care because I worked with them for just about 3 years.

After this, my phone was stolen and lost all contacts and details saved on my phone. Just two days ago, I checked my online accounts and email with someone's phone and I saw credit alert of November estacode from the company again. Now if I want to refund the money, what's in my account is no longer up to 10k because the account is on RED. I no longer live in that city and will need to connect with coworkers on Facebook to get accountant's phone number. I live from hand to mouth now and will need enough time to gather money to refund the money upon getting accountant's number.

This company may be trying to set me up... Should I report to the police before they will use same police to harass me? Should it be police PCRU or police in my current town?

Hmmmm, so what's your plan?

I think you should find out who prepares the voucher for such payments. It may not be the accountant. Or it could be an auto payment. If your account detail is not deleted from their data base, you will still be getting the estacode every month.

In the issue of not responding to your resignation, some firms don't have a protocol for responding to resignation. What they are used to is sack. So when resignation comes, it looks awkward to them.

You should try to get the fund and wire back to them then send a mail that they should make amendment where necessary and if they refused just ignore it and make sure a copy of the mail was documented.

Also, you should ask the accountant on the reason why the problem kept on reoccurring and if possible record his voice.
Regarding the pension money leave it for them because even the funds in your pension account is not even accessible except you're able to provide all the problematic documents.

Mail Them ASAP, and text the accountant too. Just detail your resignation and inquires about the payment. Remember to request for the account to refund the wrong payment into.
Perhaps consult with your legal adviser.

Lol. You nid to grow some balls. In the end nothing anybody fit use anybody do. As them dey try set u up, set them up too. Go police station go write statement to this effect. Find a way to call the company and record your conversation. And live ur life. When they hit, you hit them back. There are billion ways you could make them bleed. Begin to discuss with a lawyer to this effect. Nobody get the monopoly of madness.

I don chop two months salary of a company after I left there b4. Because dem dey try to prove madness. Company wey no follow any govt law. Ordinary CAMA and industrial laws dem no follow. Won dey form commando.

If they continue to credit your account. You don't need to worry. Nothing like set up. I don't see any thing set up for u. Because you re not person that credit yourself.

Secondly, your pension contributions is your right.
Seek for your right.

Send an email to HR copying the accountant, notifying them once again of your resignation (attach resignation letter). Also request in the email for account number for the refund of the estacode they had paid to you. If they acknowledge receiving the email, that's perfect.

If they do not respond, write a letter and physically deliver it to your former office and have the letter stamped and acknowledged. If after this they still keep sending estacodes to you, just invest the money into a mutual fund account every month.

Whenever the company comes to their senses and come threatening, get a lawyer and negotiate for the payment of your pension from the estacode money they sent to you, use the accrued interest from the mutual fund to pay off your lawyer. grin

Write letters addressing the different issues identified in this your post.

Get to mail then through couriers so that you can get a written confirmation or signed copies of letters delivery and received and also keep a copy of those letters

The reason is that in case they come up with a case against you show them evidence addressing the concerns and how you have waited for reasonable time and since you don't have a contract work relationship with the company you need to fend for yourself by engaging in other source of living.

Also get a police report addressing all these issues addressed in the mail as backup

My advice as a HR Professional:

1. Did you submit your pension account upon joining?
2. Was a detailed contract of employment signed?
3. If no pension account was submitted, it is still their right to remit pension for you (Employee + Employer contribution)
4. Write them again stating you have their 5K balance + the 10k estacode for November paid to you which you want to refund immediately as you know you are not entitled to it (put it that way despite you know you can't afford to return it now). However, request that your pension for the three (3) years with them be remitted into your pension account which details will be included in your email and emphasize it is your entitlement as an employee (attach evidence: labour law).
5. If you don't have a pension account, approach a PFA immediately to open one.
6. Let us know their feedback.

The law is clear. Once an employee resigns, he has resigned.

Was the resignation letter acknowledged?

If yes, you have no issue. Just do this;

Wait for 6 months. After 6 months, apply to your pension office directly and request for 25% of your RSA. You have the legal right. Submit all necessary documents and watch as the accountant will quickly remit the balance of your unpaid pension with magic.

Many years ago, I worked for one useless bank in Nigeria. I resigned and letter was received but not acknowledged . Few years later, i needed the acknowledgment for another stuff and requested from the bank. I got a mail that they wont issue the acknowledgment because some of the loans i worked on went bad and i have to help on recovery.

I simply responded telling them i have no issue with that but they should credit my account with unpaid salaries for the few years since they still want to treat me as staff. I got the acknowledgment via mail and via DHL sharp sharp.

But why did you resigned from a Job when you haven't gotten an assured Job elsewhere? With the current country situation. Now you are living from hand to mouth. Even your phone you don sell am. Abeg get in touch with the Accountant about what's going on. May God be your strength.
