Bearing a child is the joy of every woman as they want to carry their own child, but due to fertility issues, alot of women are not able to hence the need to find other means to have a kid and one of such means is surrogacy in which another woman carries your baby in her womb.Is this practice of surrogacy backed by law in Nigeria and what will the foreign embassy say if the babies are to be flown out of the country. Will they query the mother of the kids as most times she can't breastfeed the kids as she is not the real mum of the the kid.

Surrogacy is gaining momentum in Nigeria... There is no law against it.
But ensure you tidy up your legal deal with the surrogate mum to avoid stories.

You are legally the mother of the baby as your ova(egg) and your husband's sperm are used to form the baby in the carrier (surrogate). The genes and DNA of the baby is that of you and your husband. So, even with DNA test, you own your baby

it depends on which type of surrogacy you are talking about... did the father actually had sex with surrogate mother? was she inseminated with "their" fertilized embryo or did they used hers?

for the embassy, if both parents aint the biological one then they can simply adopt the child as soon as it is born, et voila!

BTW why would anyone care what in laws say, so long as these people happilly fulfill their dream of becoming parents?

okay ,but why is the woman not able to breastfeed the baby if they are her gene.

Because she did not carry the baby in her womb, there will be no secretion of the necessary hormones that will signal to the brain that the breast needs to secret milk. If there is no breast milk secretion, she surely can not breastfeed the baby.

Nice point, people into surrogacy secretly do it and you hardly get much details how it was done.Baby just arrive and that is it.

... and sometimes, depending on how they did it, it could be smooth sailing and/or a big headache (especially if daddy had sex with surrogate and she suddenly decides to want to keep the baby or have shared custody)

That is why they pay the surrogate mum heavily and travel abroad so that the surrogate mum can't reach them easily

i once read a story where surrogate was paid heavily and when she gave birth, changed her mind and there was nothing parents could do as she was the biological mother of the child. depending on which country you are, some of these contracts aint worth the paper they are written on.

true.... also, many women believe they dont want children anymore but wanna help infertile parents, but then as they get pregnant and their hormone starts kicking in, the bond with the unborn child is just too strong/much and they cant separate from that child

No law is against it and the US embassy know much about surrogate babies and the mothers....

Why worry about what your siblings or the woman's siblings will say? Your family comes first and your decision as the head of the house is final...

surrogacy is legal in Nigeria...but please if you must do it,make sure you follow the right channel by getting a SURROGATE LAWYER involved to avoid any issues...likely issue is the surrogate mum refusing to let go of the baby after birth because of the "bonding" she has with the baby during the gestation period (mothers would understand/explain this more)...so get a surrogate lawyer involved and proper documentation...some surrogate mum would agree at first...after birth, they just can't let go

Then your last question...about going abroad... Western countries recognize surrogacy...and as long as the DNA test is done and it matches with the parents..which is likely because the ova is from the mum and the spermatozoa from the dad..so no qualms at all...

BUT PLEASE USE A SURROGATE LAWYER TO AVOID COMPLICATIONS AFTER THE BIRTH OF THE CHILD

About your siblings...that shouldn't be your issue...the major thing is that you have your baby...
