Gov. David Umahi of Ebonyi State has alleged that the Peoples Democratic Party (PDP) is currently writing petitions against him to the Economic and Financial Crimes Commission, EFCC.

Umahi, who stated that his administration will conclude its tenure on May 29, 2023 despite the fights from the opposition party, his enemies tried using the Independent National Electoral Commission, INEC and the courts to end his administration abruptly but failed.

The governor stated this on Friday while reacting to the judgment of the Appeal Court in Enugu State which affirmed the judgment of the Ebonyi High court on his defection.

DAILY POST recalls that the Ebonyi High Court had quashed a suit challenging the defection of the governor from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) in Nov. 2020.

According to the governor, “The enemies have tried using the Independent National Electoral Commission (INEC) and the courts but failed.

“They are presently writing all forms of frivolous petitions to the Economic and Financial Crimes Commission (EFCC).

“We will, however, defeat them anywhere they go and will finish strongly.”

Clear conscience fears no accusation governor Dave Umahi. After all the same EFCC is the rein in bulldog of the regime you now belong to.

I don't know what Umahi is celebrating. The case thrown out was one someone wanted to reap where he didn't sow. The plaintiff said since Unahi had been thrown out he should be sworn in as the governor for coming second in the election that brought in Umahi. It is a different case from the one that threw him out.

Umahi should stay focused as the aim here is just to distract him from finishing the wonderful jobs he has been doing that has exposed the wickedness and incompetence of his counterparts

Can a seat of a governor be declared vacant on account of defection ?

The appellate court said NO

The Appellate Court in an unanimous judgement delivered by a three-man Panel (Justices A O Belgore, J O K Oyewole and Sybil Nwaka-Gbagi), held that, the defection of a political office holder may appear immoral, but it was not the duty of the Court to embark on investigation or probe into the provisions of the laws, warning that judicial activism must not be turned into judicial rascality.

The Appellate Court further held that there is no provision in sections 180, 188 or 189 of the 1999 constitution as amended, that empowers the Court to remove either a seating governor or the deputy.

According to the learned Justices, defection of an office holder is not novel to Nigeria’s judicial jurisprudence
