Human rights lawyer, Mr Femi Falana, SAN, Wednesday, declared that former President Goodluck Jonathan cannot contest the 2023 presidential election by 137 (3) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

There have been speculations that the former President may defect from the Peoples Democratic Party, PDP, to the ruling All Progressives Congress, APC.

Jonathan was elected President of Nigeria in the 2011 election but lost to Muhammadu Buhari in 2015.

Falana, in a statement, said: “It has been confirmed that former President Goodluck Jonathan has decided to join the All Progressives Congress, APC, to contest the 2023 presidential election.

However, the former President is disqualified from contesting the said election by 137 (3) of the Constitution of the Federal Republic of Nigeria, 1999 as amended which provides as follows: ‘A person who was sworn in to complete the term for which another person was elected as President shall not be elected to such office for more than a single term.’

He won't contest, he's not desperate as Tinubu who's always greedy. But if he showed interest in APC, the ticket is dancing straight to his hand. That's to say that Tinubu is nothing.

All these analysts is not necessary. He should join APC and contest the primary. If he wins, fine. If not, he will support the winner. This is democracy and all interested aspirants should be encouraged to contest.

If Falana is right about the constitution, then Jonathan's Presidency is a dead duck.

Giadam served 3 terms in Borno

First 2 years was after the death of former governor Bello Ali whom he deputized and later won 2 consecutive terms for himself

You are talking democracy without the respect for rule of law. According to Falana, he's constitutionally disallowed not to contest.
Rule of law and democracy is interwoven.
So the analysis is very necessary.

Others may argue that the law cannot take a retroactive effect and Jonathan is not affected.

Retrospective effect is if he already applied to contest before the law was made.

He cannot apply now, as he's barred.
