BREAKING: Dagogo’s Suit To Stop Rivers PDP Governorship Primaries Fails by Kwanza: 2:11pm On May 25, 2022
The Federal High Court sitting in Abuja on Wednesday dismissed an application filed by Rivers State governorship aspirant, Hon. Farah Dagogo, seeking an interim order to stop the People’s Democratic party from holding its primaries in Rivers State.

Justice Taiwo Taiwo held that the application was not brought on time and that the court could not be induced with his claims for urgency.

On Tuesday, Dagogo, through his counsel, D. Lanre SAN, accused PDP of conniving with Rivers state Governor Nyesom Wike to prevent his client from participating in the governorship screening exercise.

But the PDP had challenged the court’s jurisdiction on the matter and argued that Dagogo wanted to frustrate the PDP primaries.

The Independent National Electoral Commission asked the judge to refuse Dagogo’s exparte motion.

On Wednesday, Justice Taiwo agreed with the defendants and dismissed the suit.

He then adjourned to June 7 for hearing on Dagogo’s substantive matter as well as the issue of jurisdiction raised by the PDP.

In his main suit, Dagogo asked the court to determine whether it was lawful for PDP not to screen him even after he had complied with all instructions by the party’s screening committee.

Frankly Dogogo doesn't have a case.

Even though his arrest and detention was all politics, but he dined with the devil and he got served.

Wike has done such underhand tactics all his life and his former ally and partner in 'crime' Dagogo is the victim this time.

Legally he cannot stop the primaries, they have used their power as government, collected his 20 milion and locked him up for a month,
he should lick his wounds and move on.

The case has not been thrown out, but his motion for the court to stop PDP from conducting primary election until the matter is settled by the court.

What does it mean?

The Primaries will go on and the subsequent suit will be thrown out, you'll see. He should be sueing the Police not PDP & INEC.

What is his case?

His case was to restrain INEC and PDP from conducting the Primaries without him, was that not the case? He wanted an ex-parte and it was disallowed, so the Primaries will hold and the substantive will be thrown out as well.

The Judge said they can not grant his motion to stop because of the time is too close to hear the case and act on it.

Not that he could not stop it but that they filed late.

Your stance was that the Judge does not have the power, the Judge says I do have the power but the time is too close for me to hear both parties to act.

Look at you.

By the time the court is ready to hear his case, it would have been overtaken by event.

Sorry brah, it seems you're his friend. Dagogo and his likes represent an uncherised menace to the greater Rivers society. Like I said sometime, it is an affront on the good people of Rivers State that a known cultist and/or militant should attempt to become our Governor. It is an affront, at its worst.

Where did you hear that a Judge can stop the Primaries?
Where did the Judge say he had the powers?

The motion the Judge was speaking about was for Farah's screening, he had the powers to order for his screening even though it will be upturned by the higher Courts not stop the Primaries.

I repeat again, with the old Electoral Act and this new Electoral Act, even the Supreme Court does not have the powers to stop the Primaries of a Political Party, they can only affirm or nullify it.

Stop the Primaries, No, they can't.... I repeat, they can't.

Justice Taiwo Taiwo held that the application was not brought on time and that the court could not be induced with his claims for urgency.

That is exactly what this statement means. If it was brought earlier, I could have stopped it but I can not stop it based on the claim of urgency.

This shows exactly that the Judge has the power.

You are making me repeat myself many times, did Farah apply for the stopping of the PDP Primaries? NO.

The aspirant is seeking “an order of interlocutory injunction restraining the 2nd Defendant either by itself or any of its officers or agents from monitoring the conduct of 1st Defendant’s primary election for the gubernatorial position for Rivers State on 26th May 2022 or any other date fixed, without the name of the Plaintiff on the list of contestants for the said primary election pending the hearing and determination of the substantive action.”

This is the Summary of his application to the Court. Was he trying to stop the Primary?

Second. Defendant here was INEC.

Exactly. The Judge wants to hear the Jurisdiction argument. After that, he will on it and face the case. The matter is still very much alive.

It is only a fool that wouldn’t know it will fail.

APC rodents and Tinubu urchins have been rejoicing that PDP will not have guber candidate in Rivers State but I’ve been laughing at them.

I read the interview that his lawyer granted and in his whole narrative, there’s no where he stated any role that PDP played in Dagogo’s ordeal.

PDP did not call police to arrest him when thugs attacked their secretariat, it was the state government that did and the state government has every power to protect the lives and property of Rivers people including the PDP secretariat. So it is not out of order that he was arrested.

Again, he alleged that PDP deliberately waited to screen him last until he was arrested on the day of PDP governorship screening but he can’t prove that allegation. Him being screened last was mere coincidence and PDP has absolute no power to stop his arrest.

Similarly, he contended that PDP ought to wait for him to be released before they continue the governorship primary process… But is that possible in light of Electoral Act 2022 where party primaries has a deadline as set by INEC. Or why would Hon. Dagogo want PDP to join him in suffering the consequences of his actions? That’s bad fate.

So, I can tell you categorically clear, that Dagogo has nothing on Rivers PDP from High Court to Supreme Court.

He only has case with Rivers State government.

So zombies should rest.

What will the Judge rule? When the case has become academic.

I have told you to leave this matter and you no wan gree. OK nah, we dey here.

It's just like Rochas now writing to INEC to block APC Primary until EFCC releases him. Will that not be laughable?

That is the application, not the summary. The summary is that Farah does not want INEC to monitor it, which would have made the process futile and not recognized by INEC.

This stopping the process. There is no Primaries without INEC.

Go and advise Rochas to write his own too, he shouldn't join EFCC in the suit oooo, he should just write APC and INEC and show them videos of how they attacked his house and see whether that lawyer won't be sent back to Law School.

The case is still on. The Judge did not stop the case. He just turned down an injunction to stop the process while he hear the case.

If you have a land case to claim ownership and you apply for an injunction to stop the occupants, if the judge rejects the injunction, it doesn't mean the case is over.
