Justice Inyang Ekwo of the Federal High Court in Abuja has fixed Thursday to deliver judgment in a suit seeking the disqualification of Governor Adegboyega Oyetola of Osun State as the All Progressives Congress (APC) candidate in the July 16 governorship election.



Justice Ekwo fixed the date on Wednesday after counsel for the parties adopted their processes and presented their arguments in the matter.

The plaintiff in the suit and a chieftain of the APC, Moshood Adeoti, had filed the matter through his legal team led by a Senior Advocate of Nigeria (SAN), Chiesonu Okpoko.

Adeoti contested against Oyetola in the February 19, 2022 governorship primary of the APC but came distant second while Lasun Yussuff came third.

In the originating summons, he prayed the court to nullify Oyetola’s candidacy on the grounds that the governor contested in the poll as a member of the party’s Caretaker Extraordinary and Convention Planning Committee (CECPC).



The plaintiff said the act contravened the provisions of Section 222 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and Article 31(iii) of the APC, October 2014 (as amended).

According to him, the second defendant (Oyetola) ought to have resigned his membership of the APC’s CECPC and leave office as an officer of APC at least 30 days prior to the date of the Osun State primary election, to qualify for participation in the said party primary election.

Governor Oyetola is seeking to extend his tenure in office by another four years, having won the last election held in 2018.



The court will deliver judgement on the suit seeking to disqualify him two days to the date set by the Independent National Electoral Commission (INEC) to conduct the election.



Ahead of the poll, the APC held a mega rally in Osogbo to canvass support for its governorship candidate before the deadline for campaigns.



Party leaders at the event held on Tuesday include APC presidential candidate, Bola Tinubu; Senate President, Ahmad Lawan; Governor Babajide Sanwo-Olu of Lagos, Governor Abdullahi Ganduje of Kano, Governor Babagana Zulum of Borno, and Governor Atiku Bagudu of Kebbi, among others.

APC National Chairman, Abdullahi Adamu, as well as the party’s vice-presidential candidate, Kassim Shettima, were also present.

It's like this one is high on garri....so a Governor that is part of a special committee within his party should first resign from the committee? Like does that nullify his status as an elected governor? The case should be thrown out with charges awarded against the plaintiff.

Ekwo is very independent and explicit but One thing is certain, irrespective what happens, it will fail at the Supreme Court. We know it was all about technicalities and I was one of those who didn't support that judgement. However, the Supreme Court is the final b/stop.

I am looking at the SC's lead judgement in Jegede v Akeredolu:

In any case, the 2nd respondent (APC), a registered political party being a voluntary organization, the questions of who should hold offices in it, whether it can appoint its member to hold office in acting capacity or authorize a member to exercise the powers of an office in it and whether it has violated its own constitution by appointing a member to hold a particular office in it or discharge the functions of that office, cannot be entertained by any court. Those questions deal with the internal administration of the internal affairs of the political party. Those are non-justiciable questions. Courts have no jurisdiction over the internal affairs of a political party except where a statute expressly gives a court jurisdiction deal with any internal affair of a political party.

How can you be the judge in your own case? It is both morally and legally wrong but in the jungle here, anything goes. Black market judgements are for sale and courts of law are for the highest bidders. They have destroyed this country.

However, I believe that this might be Ariwoola’s first major task especially if he was truly helped to seat by some interested parties.

Maybe I should have indicated “paid office/appointment/job” which is what the constitution says.

Chairman of Governors Forum is a paid office.

Chairmanship of a primary election committee is not a paid job.

Can Oyetola prove that he served as member of APC CCEPC for close to 2 years without being paid?

If the answer to the first question is yes, then what explanation do you and Oyetola and APC have to offer over the brazen disregard for Article 31(iii) of the APC constitution which bars an elected official from holding a position in its NWC?

The issue is not Ekwo. I can even guess where he will lean, the higher Court is the 'koko'.

He is a sub committe member not a member of NWC. A subcommittee member is not an executive office. A similar case if I am not mistaken has been decided in favour of the APC Buni NWC. This case is just a waste of time and an academic exercise and will be decided in favour of the respondent, Oyetola.

Exactly,you cannot be a judge in your own case. I just hope the judgement will favour Oyetola so that the election can come and go peacefully and if he is to lose he should lose at the polls and not losing through this error on his part. It will be too hard to swallow if the judgement is against him

Do you remember why the Supreme Court ruled against Jegede in the Ondo case?

Because Buni was not joined.

Jegede’s lawyers tried to argue that by constitutional provision, Buni cannot be sued but majority of the justices disagreed. That was the premise upon which the Ondo case was dismissed and not because it lacked merit.

Now, I’m sure, Adeoti’s lawyers must have properly joined all parties which would ensure that the technicality upon which Supreme Court decided the Ondo case will no longer be there. On what basis would the courts dismiss the case?
