Because the Supreme Court was yet to interpret that the tenure of a governor should run for 4 years from the day he was sworn-in, gubernatorial election took place in Anambra and Andy Ubah was declared by INEC.

Note: INEC did what was legal and constitutional as of then.

Now, Obi went to court and pursued his case till Supreme Court where he was reinstated as governor and allowed to finish his 4 year tenure before winning re-election.
