Respite has finally come to tenants in Lagos as the state governor, Mr Babatunde Fashola, has signed into law a bill that will make it unlawful for a landlord or his agent to demand or receive from a sitting tenant rent in excess of six months.

The law, which explicitly harps on the rights and obligations under tenancy agreement and relationship between the landlord and tenant, will go a long way in addressing the problem of housing in the metropolis.

According to the Lagos State Attorney-General and Commissioner for Justice, Mr Ade Ipaye, a defaulter of the law would be liable to pay a fine of N100,000 with the option of a three-month jail term.

The law also stipulates a six-month quit notice for a tenant who pays the rent yearly, with the clause that a tenant might apply to court for an order to stop unreasonable increase of rent by the landlord.

In a situation where the increase is unreasonable, the law allows the court to order the landlord to reduce the amount.

The law also makes it unlawful for a landlord to eject a tenant from any premises pending the determination of the action by the court.

On offences and penalties, the law says that any person who demolishes, alters or modifies a building in order to eject a tenant without the approval of the court shall be guilty of an offence and is liable to a fine of N250,000 or six months imprisonment.

It states further that any landlord who forcibly ejects a tenant, threatens or molests a tenant by action or words will be liable to a fine of N250,000 or six months imprisonment.
Commenting, Fashola said that the law would address the problem of housing as the state continued to explode in population.

Dammit! My dad is a landlord

This is so rub.bysh! This is a bad precedent. How can the government tell landlords what to do in a free market environment? Is everything not Laissez faires anymore? When landlords were building their houses at high cost plus several Omo Onile palavers, where were the government? Landlords should always endeavour to be reasonable with their terms and agreements but If you as a prospective tenant don't like their contract terms, try elsewhere! The real problems are the agents, lawyers and estate managers! They are the shylocks in the industry. If government can't sort those peope out for real, they should face their so called low (high) cost estates and leave Landlords alone!!

Good law. However, will tenants be able to challenge unreasonable rises and malpractices in courts given the costs? Maybe we need to look at a legal aid system?

I do like the development though. I hope other state governments emulate fashola.

Just imagine you pay house rent two years. Then you pay agent fee and then agreement money. Wtf is agreement money.

Is this law efforceable? Govt should focus on developing low-cost housing estates and let the free market forces determine the rent.
This is very undemocratic and anti-investment. We will see the opposite effect, rents will sky-rocket.

mr fashola is joking,I am still in search of a two bedroom flat and Thε one I got said 600,000 for 2yrs (whitout agent fee)I can't see any of his contribution tơ Thε development of housing in Thε state and he brought out a new law with no agent or body tơ enforce it,how is he going tơ no what is going on in my street or are we all going tơ queue in his office and start reporting tơ him what d landlords has done?with d issue of jail,I think he needs tơ turn a whole LGA tơ prison yards SƠ as tơ meet Thε inflow of landlord turning tơ a criminal,

It is quite a good development but I'm worried about its full implementation. A lot of Fashola's laws are facing the problem of implementation. On cursory look, I think their is the tendency for rent increment!

@ esanyonmi,that is well said,someone i know is also similar challenge from this so greedy lagos landlords. The guy in question was trying to sensitize the lanlord bout this development but he stood his ground on 2yrs rent. BRF should look for way to implement this law. Lagosian are tired of this paper law.
