INEC Has Violated The Electoral Act 2022 Over Failure To Transmit Results by Crimecity: 10:04pm On Feb 26, 2023
By virtue of Section 60 (5) of the Electoral Act 2022 and Clause 38 of the Regulations and Guidelines for the Conduct of Election, 2022, presiding officers must transmit results to the INEC Result Viewing Portal on completion of elections. Failure to comply is a criminal offence.

A presiding officer that violates this requirement is liable on conviction to a fine of N500,000 or imprisonment for a term not less than six months. This is how important the issue of electronic transmission of results to the INEC Result Viewing Portal is under the law.

Given the nationwide substantial failure of presiding officers to transfer results to the INEC Result Viewing Portal as mandated by law, this election was conducted in contravention of the law. The INEC has admitted this contravention and there should be legal consequences.


By Section 134(1)(C) of the Electoral Act, non-compliance with the provisions of the Electoral Act is a ground for challenging an election.

The Prof Mahmoud-led INEC has failed and it is very shameful. He has taken our electoral system backwards. He should be held accountable.

If the portal did indeed fall over due to high traffic from the national elections (which is possible since it had only been previously used for regional elections) then it’s surely not right to prosecute anyone.

That their system wasn’t proper load tested is a monumental failure in itself though, if that’s even true and not an excuse for rigging.

Just a shambles all round

This is what INEC will do...due to pressure and no wanting to expose their atrocious rigging. They will declare that no candidate met the constitutional requirements ....

Thereby declaring the election for a second run-off ballot...they will choose APC and PDP strongholds, which will definitely make Labour Party to lose woefully.


Nigerian youths let's watch and see. We are going to beat them to their own game.
