How did he become a SAN?



There is nowhere in the constitution where it says that Abuja must be won.



The dispute has always been whether 25% was needed there.



My mother was a judge and she had always maintained that the section was flawed, and open to different interpretations.




Agbakoba pointed this out in 2022.




Nowhere is it stated that Abuja must be won.

This is the final proof that Nigeria is a joke and the constitution is wack 😒 Imagine a SAN suggesting that you can win all the states but cant be president if you don't win Abuja. Make we even leave law, is that sensible in a democracy? We should all be leaving in Abuja na. Why can't they just do the election in Abuja na? Why una dey trouble us?

He is not correct.
What would have been the alternative word? OR?
If we have OR, it means the candidate needs to win 1/4 in 2/3 of the states or he wins just 1/4 of only fct, which can never be the spirit of the law, imagine losing all states, and win fct, but the 1st to like 5th have very high votes, then you now have to conduct a run off between 1st majority with no adequate spread and 6th position just because he won Abuja

36 states and FCT effectively means 37 states.
So 2/3 of 37 is no more than 25.
You win if you have a majority that covers 25 states or more.
What is special about FCT?
You might as well say someone must win in Gombe or Bayelsa before legally becoming a valid president.

The word AND is conjunctive hence 36 states and Abuja, meaning a candidate must have 25% in two thirds of 37 entities. What kind of dumbass SAN would believe the Constitution grants Abuja special privileges above other states when it comes to elections? If that was the case no need for campaigning in other states, everybody would have put all their energy towards winning Abuja.....Rubbish and Kwankwaso!

But what does this have to do with anything? Does the Constitution say you should win 25% of 2/3 states with the FCT or does it say 25% of 2/3 of states and the FCT?

These are two very different statements.
