DeOTR:

There's no where in the constitution that states a candidate must win the FCT to be declared the winner, no?
Section 299 or is it 290 already instructs us to treat FCT as though it's a state in the federal in constitutional matters.
Sticking to allegations of rigging would have been the best best for Obi, banking on an ambiguous section of the constitution.
They'll use the ambiguity to knock your case out.

The Constitution in stipulating the requirements for election as Nigerian president states in Section 134(2) that a candidate must (a) have the highest number of votes cast at the election; and (b) have not less than 25% of total votes cast in at least two-third of all the States in the Federation and the FCT, Abuja. Clearly, it appears that the Constitution creates two hurdles that ought to be crossed by a candidate before the Independent National Electoral Commission (INEC) can return him or her as president of the Federal Republic of Nigeria.

There you have it, you can rest now and stop the noise.

Because there are no evidence of rigging or malpractice anywhere. So in a bid to keep the struggle going. They had to rope in an already dismissed charges. These charges have been taken to court already different times and all ended up been cleared and dismissed by the judge with the latest one coming from justice Inyang of Federal high court, i think, just 2months ago, PDP filed that suit. I remember so well.

These are not even normal electoral crime or malpractice that occurred, these are charges that has nothing to do with the main voting and declaration of result.

And to answer your question plainly, no lawyer in this world will ever reject a court case. They will never tell Obi he has got no chance. How lawyers go take chop?[/quote

This not true. Gani fawehimi rejected cases many times. One example is the case of Rashidi Ladoja of Oyo state against the FG(Obj Govt.) for illegal impeachment.

Unarguably, Wole Olanipekun is one of the brightest SANs in Nigeria and one of the richest as well - thanks to his ability to win cases for the political class.

Well, it will be interesting to see how he will defend the sham election that threw victory in the laps of Druggie as well as prove Druggie's eligibility after working as the chief financial officer for Chicago drug cartels. cheesy

Which sham elections? It was not a sham in the states where you have almost absolute majority votes, but it's a sham in every state where you lost. The election is like every other Nigerian election and Tinubu won it.

Tinubu had an out of court settlement in a civil case. He was never indicted and the case was DISMISSED WITH PREJUDICE. It is a closed case that can never be reopened.

INEC can decide to transmit result anyhow they like. INEC guidelines recognize both manual and online transmission of results. The court will not nullify the election because some results were not immediately transmitted to IREV as a result of network problem. The non-transmission did not affect the outcome of the election in any way and the manual transmission is enough to complete the process.

Tinubu is not on any rope and Wole Olanipekun is actually drinking beer because this will be his easiest case so far.

Dude calm down a pleasure bargain or an out of settlement according to the US law mean he is guilty as there was substantial evidence linking him with narcotics trade. Again INEC made a claim adecided to go against the claim without obvious resource to the political parties noooo. INEC and Tinubu are on the ropes Wole Olanipekun trying to quash the case for lack of merit will not work.

Do you know what it was for? Fact is the court never found him guilty of anything. So focusing on 460k is irrelevant. Even if you did something and a court investigated you but did not charge you, no case anywhere in the world. After the court case, it’s just beer parlour gist. Court does not work with assumptions, gossip and emotions. No court will retry someone who has already been tried and set free. Obi is just deceiving you all.

Court never found him guilty of anything and he still paid a fine!!!! Bros what did you smoke? In US a plea bargain or a deferred prosecution agreement means he entered an agreement with the US government either in exchange for a lighter sentence or avoiding Jail time for an offence of which circumstantial evidence of which a guilty verdict was reached. So he was in all intents and purposes guilty as charged.

The man must be rolling on the floor in his chamber right now. Laughing so hard at the med!ocre petition filed by Labour party.

If you know wole Olanipekun so well, you will know the court will be done within hours barring any ceremonial adjournment just to make the sitting look atleast a little bit solid.

Chief Olanipekun, SAN, OFR, CFR that made A!T of partisan Raymond Dopkes! ' crawled on the floor and begged for their life' claiming it was the 'dev!L's work' when Tinubu through Wole Olanipekun slammed a 150Billion naira lawsuit against them for defamation in 2016 on this same 'druglord propaganda'.

When was the last time you saw A!T, a pro-PDP media house ran any anti-Tinubu campaign on their station during this electioneering period? They were quiet all through the campaign period, unlike before; Olanipekun put them in their place.

I wont be surprise if after this case is done and dusted, Tinubu will also drag Labour party to court for CHARACTER ASSASINATION & DEFAMATION . ( Dem go slam 300billion lawsuit against Labour party, and you obidients will just wail and cry about it for nothing. And i hope you dont cry: 'government suppression & oppression' then.)

Mumu post, are you saying this criminal lawyer defending criminals in Nigeria is going to win the commonsense of Nigerians and the entire world who have seen the election for what it is "a rape of democracy"?

There is no sensible judge that will deliver a judgement to a worldwide public opinion about something with more than enough evidences in public domain.

299. The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly .

Why should a candidate that had the majority votes and at least, 25% in 30 states of the federation not be declared winner if the above quote is true that FCT is treated just like a regular state of the federation?
What's your special about the residents of the FCT (I live there) that a sitting President must have at least a quarter of their vote?
So the INEC should conduct a rerun election because a candidate got 80% of the votes in the FCT and he's not the one with the majority vote?
