The Osun State Public Servants is giving heroic welcome to His Excellency Governor Ademola Nurudeen Jackson Adeleke to the State Government Secretariat this morning as a mark of solidarity for his triumph at the Court of Appeal, Abuja.

PDP VS Gboyega Oyetola, APC &Ors:

"I have also reviewed the evidence before me as to why the Judgement of the Court of Appeal in Appeal No: CA/A/362/2019 ADELEKE V RAHEEM & ORS was rejected in evidence. The reason is that the said document, being a photocopy of a CTC of a public document was not certified. Is that the Law? The law as I know it is that a photocopy of a CTC of a public document does not require re-certification to be admissible in evidence. I had reviewed a number of decisions of the apex Court and arrived at this position in the case of HOTORO V ISYAKU & ORS (2019) LPELR-48231(CA). See also the following– NJIBOLA V TALABI & ANOR (2022) LPELR-57353 (CA), ESIONE V ISIOFA (2016) LPELR-41060 (CA), MAGAJI V NIGERIAN ARMY (2018) LPELR-1814 (SC), BREDERO (NIG) LTD V SHYANTO (NIG) LTD (2016) LPELR-40205 (CA). In the light of the authorities, I set aside the decision of the Tribunal rejecting the Judgement of the Court of Appeal in Appeal No: CA/A/362/2019 in evidence."

INEC VS Gboyega Oyetola, APC &Ors:

"With the terse and scanty reference to the various preliminary objections properly laid before the learned Tribunal and the lumping together of same without giving them individual and dispassionate consideration and determination, the Tribunal has failed in the performance of its statutory duty. Because issue of jurisdiction as raised in the preliminary objections constitute the livewire and access to the consideration and determination of the substantive issues before the Tribunal, the said Tribunal ought to have done better. The appellant as well as the 3rd and 4th respondents are in the circumstances robbed of their right to fair hearing and a miscarriage of Justice, which is capable of rendering the proceedings and Judgement of the Tribunal a nullity and of no effect. Issue 2 (two) is accordingly resolved in favour of the appellant and against the respondents."

Appellate Court held that Photocopy of a Certified True Copy of a document is Admissible in Evidence, as Appellate Court supported this holding with series of Supreme Court Authorities;

Appellate Court lampooned Justice Kume led Osun Gubernatorial EPTribunal for ignoring/rejecting the Judgement of Court of Appeal where Senator Ademola Adeleke had been cleared and exonerated from any Certificate or document forgery. The Appealate Court went further by saying even though if Adeleke didn't tender the Judgement of Court of Appeal delivered on 30/5/2019 as Exhibit, the fact that his Lawyers cited the said Judgement in form of Superior Court Authority in the final written address at the Tribunal is enough for the Tribunal to bound by the said Judgement.

Appellate Court held that the Judgement of Court of Appeal delivered on 30/5/2019 in Adeleke VS Raheem & ors is a Judgement in Rem as issues sorrounding the Testimonial of Ede Muslim High School of Senator Ademola Adeleke and which Tribunal revisited had since been settled and laid to rest in the said Judgement and Judges of Osun Osun Gubernatorial EPTribunal are bound by the said Judgement.

Osun 2022 Gubernatorial Election:

Still on Court of Appeal Judgements;

The Lord Justices of Court of Appeal UNANIMOUSLY held that it's settled in Law that onus of prove squarely lies on the Petitioners and more particularly that the prayers/reliefs of the Petitioners from the Court are DECLARATORY ones. The Appellate Court went further by saying that weakness or mistake in the case of Respondents can never be an advantage or strength of Petitioners' Case. Appellate Court cited decision of Supreme Court in Omisore VS Aregbesola (2015) and other Supreme Court Authorities.

So, if Osun APC Social Media Bandits are telling you that INEC admitted that there was seemingly an over-voting in 6 polling units or over 1700+ polling units before Election Petition Tribunal, kindly tell them that the said purported admittance can't be an added advantage to their petition as the burden of prove of their petition is rested on their shoulder before they can be entitled to the reliefs they are seeking from the Court and not on Respondents' Shoulder.

July 16 Gubernatorial Election in Osun and Judgements of Abuja Division of Court of Appeal;

I just finished the reading of the Certified True Copies of the Judgements of Court of Appeal in;

1. Adeleke Vs Gboyega Oyetola, APC INEC and PDP.

2. PDP Vs Gboyega Oyetola, APC, INEC, and Adeleke

3. INEC Vs Gboyega Oyetola, APC, Adeleke and PDP.

Not by the reason of the fact that the Judgements ended in favour of the Appellants, I must clearly say that it's well considered Judgements, the Judgements are very sound in Law. The Lord Justices deserve commendation, they thoroughly dealt with all the issues being raised by Petitioners/Respondents and Respondents/Appeallants. The Judgments have enriched our Legal Jurisprudence.

One thing that is very important and fundamental in the said Judgements and which goes beyond the issue of over-voting and alleged Certificate Forgery is the issue number two that was unanimously resolved in favour of Adeleke, INEC and PDP.

Issue number two have to do with failure of the Tribunal Chairman to give ruling on all the preliminary objections that were raised against the Jurisdiction of Election Petition Tribunal to hear part of the grounds of APC and Oyetola's Petition before the Judgement on substantive Petition. The failure of Tribunal Chairman in this aspect is seen to have offended the Principle of Fair Hearing in Law. Hon. Justice James Gonmon Abundaga who read the lead Judgement in PDP VS Gboyega Oyetola, APC, INEC and Adeleke cited avalanche of Supreme Court Authorities where it's held by Supreme Court that when a Court infringes on the right to fair hearing of any Party before it (court), the entire proceedings and Judgement of such a Court is bound to be set aside.

All the 3 Justices categorically SET ASIDE the Proceedings and Judgement of Justice Kume led Osun Gubernatorial Election Petition Tribunal base on Issue two. On this alone, merit of the over-voting and alleged Certificate have become academic excercise.

Note: allegations of over-voting and alleged Certificate Forgery were heard and determined base on the strength of their merit and they were resolved in favour of Adeleke, INEC and PDP respectively.
