This case is a bit dicey, first she might not be the only one bearing Mercy Chinwo, secondly if the guy did not use her image on his music video then there is a high possibility she might not win the case but if her name has a copy right trade mark like Omotola it is a serious case, the guy can claim the Mercy Chinwo is someone else or a figment of his imagination for his music, well this is my own opinion.

Unauthorized use of name is not a case. Your name is public. Anyone can mention it as many times as they want. No court will ask anyone not to mention your name again.

The context in which the name was used would be taken by a reasonable man to refer to her... that's the reasonable man's test in law... Also when you hear that name in Nigeria, the first person that comes to your mind is her.
For me, there are 2 issues... whether the lyrics are derogatory to her and if he would benefit in sales and popularity from her goodwill in titling the song MERCY CHINWO...
