FORMER President of Nigerian Bar Association, NBA, Olisa Agbakoba, SAN, said yesterday that speedy dispensation of presidential election petitions was a strategy against having an interim national government, ING.

In a statement yesterday, the former NBA boss said there would be no need for an interim government if the petitions were heard and disposed of before May 29.

He said: “The tension around the call for an interim government is that the presidential election petition may not conclude before the inauguration of a new president on May 29, 2023.

“But it’s very possible to conclude these petitions, provided the court systems are very proactive.
“Under arbitration matters, procedural orders and or directions issue peremptorily to resolve sometimes very complex jurisdictional and procedural issues.


“The presidential election tribunals are urged to adapt the procedures very familiar with speedy conclusion of arbitration matters.”
Agbakoba listed three key issues in the presidential election petitions, which he said were resolvable by the application of procedural orders and or directions.

According to him, the first is the “interpretation of Section 134 of the 1999 Constitution of the Federal Republic of Nigeria as to whether securing 25%(per cent) of votes in Federal Capital Territory, FCT, Abuja is compulsory to be president.”

On the second, he queried: “Is a candidate permitted to stand for presidential or vice presidential election when he is at the same time a senatorial candidate?”

Let them answer those questions....
As far as justice will be served , then concluding the matter on or before May 29th will be ideal....

Infact we should have a law that prevents mandate thief's from benefiting from their loot and consequences for those who fraudulently takes political positions......

They should be severe consequences for electoral violence and fraud both to the enablers and beneficiaries of electoral fruad

Nonsense, tribunal will drag until 2027 and supreme court will drag until March 2039 when Shettima will be finishing his second term.

Swearing in a mandate thief and a drug baron who didn't get 25% in FCT is unconstitutional and didn't score the highest number of votes drop polling units is a civilian coup d'etat

This is an invitation for military takeover at best or an interim govt at worse

In all cases they are all unconstitutional

Inec and Thiefinubu are a threat to democracy in Nigeria, they have destroyed what should be a functional democracy to enthrone civilian dictatorship run by APC

I don't know why lawyers enjoy prolonging cases unnecessarily. Ideally, all cases in tribunal are supposed to be wrapped up before the swearing-in ceremony.

It is not possible, the minimum time that it will take to dispense this case is 240 days, and by that time Tinubu has already taken foothold in the presidency, when PDP was in power and Buhari used to challenge them the supreme court used to deliver the final judgment almost 2 years after the elections, we are not rushing

I don't know why people criticise men for coming too quickly calling them 2 minutes noodles.
Why take 30 minutes when you can come in 2 minutes
That is prolonging unnecessarily.

If they complete it in 30 days and it favors Asiwaju, you will still say it was rushed, they didn't allow the petitioners to critically examine, analyse, present the case! I'm sure they'll do the right thing undecided
