ON SENATOR BINANI vs FINTIRI UNENDING TUSSLE

Those who actually are said to be involved in the 1billion naira advance payment to influence the election in favor of Fintiri which led to their arrest by DSS have released their internet dogs to re-write the story and accuse Binani of their own transgression.

Well, we are focused on the election. Lie all you want, it will not save Fintiri from impending defeat.

Meanwhile, the REC of a State by Item 14 of the Third Scehdule of the 1999 constitution is responsible for management of electoral affairs at the state. INEC guidelines gives him powers to superintend over the process in every ramifications.

Unless he is suspended from his role, INEC Abuja had no powers to appoint Polling Unit Officers and Ward Collation Officers for the supplementary election of April 15, 2023. How did they compile the list? Who does INEC Abuja know in Adamawa especially as they constituted the new list without recourse to the State REC? Was the list handed by Fintiri's people to the 2 National Commissioners sent from Abuja and for what purpose? These are the pertinent questions that no one is addressing.

By Section 149 of the Electoral Act 2022, the return made by the REC which was necessitated by circumstances is valid and can only be upturned by a Tribunal. INEC Abuja cannot sit on appeal in respect of declaration or return already made.

Festus Okoye knows this. When Ihedioha was returned winner of Imo State Governorship election in 2020, he did not meet the mandatory 25% of all voted cast in 2/3 of thr LGA in Imo. Yet, the Returning Officer returned him. People complained and INEC responded that only a Court can upturn the said return. Festus Okoye did not issue his Appellate opinion declaring that return void.

Binani is up against forces who are bent on not relinquishing power to a woman. The ordinary people of Adamawa have spoken. They have chosen her but the elite in the State, across party lines consider the voice of the masses an aberration. Unfortunately for them, the Will of the people must stand.

. 1. INEC reserves the right to cancel the declaration and make another one. It can review results declaration. That is why it is called INDEPENDENT agency.

2 As for Adamawa results ,the REC is not the returning officer at all. He is just the coordinator of the election at the state level. Why announcing the result illegally?

3. Dissatified, Binani went to FHC for the redress,in my opinion this is wrong. All issues relating to the conduct of election including voting and results decalaration are Tribunal matters. The FHC has no jurisdiction to entertain it.

4 We hope she will quickly reakise it and do the right thing.

INEC has the power to review an already announced election within 7days

Not to talk of this useless announcement without result sheet and not by the returning officer
