The Independent National Electoral Commission (INEC) yesterday urged the Presidential Election Tribunal to dismiss the petition filed by the Congress for Progressive Change (CPC), challenging the victory of President Goodluck Jonathan of the Peoples Democratic Party [PDP] and to uphold the poll’s result as credible, free and fair.
INEC made the submissions yesterday as the ruling PDP expressed confidence that Jonathan’s election would be validated by the tribunal.

The electoral body told the five-man panel of Justices led by Justice Kumas Akaahs that the election that produced President Jonathan was adjudged to be free and fair by both local and international observers as well as majority of Nigerians.

Giving evidence on the credibility of the poll, the Vice Chancellor of Nnamdi Azikiwe University, Prof. Boniface Egboka, who was the Collation Officer for Anambra State, said there was no case of manipulation of results as alleged by the petitioner in favour of President Jonathan.

Egboka, who was led in evidence by INEC’s counsel, Chief Onyechi Ikepeazu (SAN), said: “All accredited agents of the political parties, had free access to me at the designated centre, but none of the agents lodged any complaint to me of any malpractice with regards to the results of the elections. In addition, available and willing agents endorsed the final result sheet and copies were given to them.

“I know that there was no case of manipulation of results of any sort, whether physical or through electronic means from the polling units to the Collation Centre at the state level where the final results were eventually collated and were subsequently submitted to the Chief Returning Officer.
He said: “All the allegations of multiple voting, manipulation of results, ballot box stuffing or any malpractice in the polling units did not come to my attention.”

Prof. Egboka denied allegations by the CPC that collation of the election result in Anambra State was done at Barnhill Hotel.
“I categorically state that the Collation Centre for Anambra State was the INEC head quarters, Awka. I collated the result from the Local Government Areas of Anambra State only at the legally-designated centre, which was the INEC headquarters. I did not at any time proceed to Barnhill Hotel for that purpose or for any purpose connected with the presidential election of April 16, 2011. I know that what I collated at the state level was the true and accurate reflection of the votes cast and recorded in the respective polling units and collated at the wards and local government area collation centres.

Another witness, Amadi Chukwunolum Chinyere, also testified to the authenticity of Anambra result.
The witness, who participated in the election as a National Youth Service Corps (NYSC) member, denied allegations by the petitioner that she was arrested with thump-printed ballot papers in favour of President Jonathan during the election.
They were both cross-examined by counsel to the petitioner and Director of Legal Services, Abubakar Malami (SAN), even as they maintained their positions on the matter.

After their submissions, Chief Ikepeazu prayed the tribunal for an adjournment to call other witnesses today. The request was granted and the tribunal adjourned proceedings for today.
INEC is to call 16 witnesses to prove that the election was free, and fair in compliance with the provisions of the Electoral Act 2010 [as amended].

Meanwhile, the PDP has expressed confidence that the petition would be thrown out at the end of the day because the election that produced its candidate as President was free and fair.

Speaking through its National Secretary, Prof. Rufai Akali, the party said that although the CPC had the right to challenge the result of the election in court, it is 100 per cent sure that victory will come the way of President Jonathan “because he won convincingly and there is absolutely nothing in the CPC’s petition that can sway the minds of the court to invalidate the election.
Prof Akali, who was in court with the National Legal Adviser, Chief Olusola Oke to observe the proceedings, appealed to opposition parties and all Nigerians to rally round the President and give him the maximum support to implement his transformation agenda.

Jega is a disappointment for not saying the truth in black and white.

The fact is that GEJ would have won, but multiple voting took place in the East.

I am sure Jega knows of this.

if your almighty jonathan azikiwe ebere messiah goodluck won as you are thinking, why are they doing their best to stop the case? what is wrong in going to court to prove yourself? why sacking ppl at the court only to replace them with his own trusted partners in crime? even fools know what it means to win an election in nigeria. do not forget the story of Chief Raymond Dokpesi who jonathan named as masterminder in the 1st oct. 2010 bombing who later became his campeign manager. forcing ppl to join you or face bombing charges is one of the ways he won? please go and borrow some brains even if is from goats and i assure you, u will do better than what u have at the moment.

is there anything wrong is going to court to challange a decission in a democratic setting? outside nigeria, ppl believe that a clear conscience fears no accussation why is it that as innocent as pdp and inec, they are afraid of proving themselves in our courts. if i am in the position of jonathan and pdp, even before this court cases, i will ask inec and jega to make available those materials just to prove how clean my hands are.

Boko guys should go for people like you and d ppl you support, you know quite well that messiah badluck lost the elections to buhari, the jentle man took his case to court, you know how your messiah changed the CJN to someone that will favor his party, Buhari's lawyers asked the court to order INEC to give them access to INEC database ( to reveal mis conduct by INEC ) and the court said NO ''imagine?'', Is this not enough for you to know that JEGA and Messiah have a lot they are hiding about the elections. The people is bleeped as much as the whole system. you should go hug high tension instead.

we are not saying jonathan did not win. all we are saying is, we spent over N80b to have a computerised system of election and our self acclaimed messiah had signed into law, the freedom of information bill(FIB), let us know how may ppl registered for the election and how many ppl that voted our popular president into power.
with the computer database that has our finger prints and the claims of jega that the system will never allow double voting, i don't see anything wrong in conviencing us that our money was well spent.
i still do not understand the fears of joe shoeless, pdp and their supporters.
free and fair elections shld be backed with evidence and the idea of checks and balances can be in use here.
if our FG is running away from justice, i am afraid the system will never change from what it is.
that criminal bankole did his best to avoid court case and pdp/joe are doing same, what is the fate of this jungle we call nigeria?

President Goodluck Ebele Jonathan WON the Presidential Election and it was transparency. I am not a Politician neither PDP member, in fact, I voted for ACN but, in my area where i voted, after voting i waited for the result to be counted, after counting the result for the presidential election, PDP surpass them no be small thing. After leaving my polling center, I also visited some polling centers to see the result, it was the same. All the enemies should close their mouths. Allow this man to deliver what God has sent him and if the enemies refused well, they should go and KISS Electric Transformer if they like.  Jonathan won!!!. Is God that put him there, NOT by his own power and he will never FAIL in Jesus Name. God will put all his enemies into captivity to enable him transform this Country (AMEN!!!).

we all witnessed Jerry rawlings delete some top criminals in Ghana for Ghana to start working. today Ghana is the toast of the world we are still not going to loose hope. big heads must roll and blood of high class criminals must be wasted for nigeria to move forward and that will surely come to pass as we will say enough is enough over the bloods of innocent and poor helpless nigerians.

1025 u said u are from imo state,and u think buhari won in imo state, now tell me: who was the governorship candidate for cpc in imo state? who is the cpc party chairman in imo state? mention one popular imo politician who is in cpc? from your answers we can now see how reasonable ur assertion is. If u are trully from imo state,u would ve not that cpc and buhari were not contenders in imo state.
