Illegal Bank Withdrawal From My Account by Welgraced(f): 2:05pm On May 28, 2023
Good afternoon all, this is my first post on nairaland even though I have been here for long as a visitor before I registered as a member .
To the main issue, on the 24th of march my husband's salary was withdrew from his account some hours after it was paid, he immediately went to his bank to complain.
They saw that the transaction was done from a microfinance bank . They promised to write to the microfinance bank to release the money . We have been on this ever since then, it's over two months now, my husband's bank is asking him to go and bring court order to take to the microfinance bank to make them release the money.
The cost of getting the court order is expensive. Please I need help, is there any other way we can go about it? We can't just let the money go just like that.

Note; He has not heard about or done anything with the said Microfinance bank before.
Thank you as help out please!

Get a lawyer serve them a petition. Court is expensive is a medieval time thinking. Our courts work. Let's do things rightly. See any order you have to. Arrest the back manager if you have to. Take action that would cause them pain

Simple. Get another lawyer. That's how the legal system works

Does the MFB have a physical branch? How did they get his account details?

They have a physical office. The withdrawal was done directly from his bank account . Not even with an ATM card or POS.

No be ATM.....no be POS..??

Another way a 3rd party organization/bank can debit an account on another bank's platform is by Remitta...... thats how some loan apps are getting their money directly from loan applicant's account...

.....ask ur husband if he ddnt take loan from them.
.....or stand as guarantor for someone who took loan and dropped his details...?? Could be his brother or girlfriend that has his personal details...
...... it could also be a case of mis-inputing wrong account number at point of debit from the microfinance end...

Many of these microfinance banks dont have many branches...i for say make u and ur husband go run the matter directly with them in their office......sadly... it could be one funny microbank in Nnewi, kano, or ogbomosho.....

Best bet.... stay on ur bank's neck...bombard them on social media and through emails, to at least get the microfinance to explain what the debit is about since u said its not an online, atm or pos initiated transaction...

from there they will know if a refund is the next thing..

Pęlę...this kind matter go drag small

A microfinance bank or any other financial institution cannot debit your account directly without being authorized by the account holder to do so.

If his ATM card wasn't compromised by a scammer and his funds wiper out, my best guess is that your husband took a loan and in the process binded his account hence the Debit. Tell him to show you the debit details of the transaction, either the SMS or email, the purpose of the transaction would be boldly written on the debit alert.

Dear OP, was the debit directly posted from the bank?
Please share the narration and your husband should plead with a CSO in his bank to confirm the credit account that the money went to. It's his right to know.
He has to be sure that he has no loan anywhere as GSI allows FIs to debit any account linked to your BVN.

He was given a print out of the transaction, it was not linked to his ATM card. It was direct from the bank.

GSI allows interbank debit from customer's account and money is used to service a non performing loan in other banks. So pls confirm again if your hubby has loan in zenith or any other bank that he's not servicing.
If no, as you follow up with court order, also write the CBN in your state to intervene.

The OP has refused to share the loan narration even if it's a snippet from the statement of account.
She claims it's a direct debit from the bank meaning a teller posted it.
If the complainant is clean, the transaction vouchers for that day will be recalled to show the instruction that brought about the debit.
Make we rest abeg.

BELLOW IS WHAT YOUR HUSBAND WILL DO.

BREAKING INFORMATION: Wrong Transfer

In case you mistakenly transferred Money to the wrong account and the owner blocked you? or you are duped thru your bank account? and then later realized that you have been scammed or a mistake on your part? And the receiving bank is not cooperating?

HOW TO RETRIEVE YOUR MONEY AFTER YOUR WRONG TRANSFER

Please read carefully and learn.

Many people don't always know what to do, so today am sharing with you things you do when you realize a page you paid for a service or goods is ghosting you:

1. Write out the Full name and account number of the page or person.

2. Go to the last notification your bank sent you after you made the payment (via mobile app or text) and copy out the "TRANSACTION ID NUMBER".

3. Go to any branch of the scam artist's bank (the bank you transferred to), and ask to see the CUSTOMER SERVICE in charge of FRAUD.

While you are there, send an email to SCAMMER'S BANK or the d bank u wrongly paid to and copy CBN FRAUD DESK (anticorruptionunit@cbn.gov.ng) n also cpd@cbn.gov.ng
& contactcbn@cbn.gov.ng, this will ginger the bank to take it up fast.

What should you expect from this? The culprit/suspect's account will be PLACED ON HOLD. His BVN will be blocked permanently. No account will ever be opened nor will he be able to transact banking business in that name until he clears himself with the bank.

Meaning he/she cannot transfer or withdraw until they visit the bank, and when they do, the bank will contact the police, and the suspect when proven guilty will sign a waiver allowing the bank to refund your money.
