Nigerians Know That Tinubu Was Not The Winner, But I’m Not Surprised By S’ Court by Mastersure: 3:03pm On May 28, 2023
According to Vanguard, Femi Falana, Nigeria’s leading human rights lawyer and senior advocate, told SAN he was in no way surprised by the Supreme Court’s ruling, which paved the way for the president-elect’s swearing-in Asiwaju Bola Tinubu of the ruling All Progressives Congress, APC, on Monday, May 29.

However, In a statement made by Falana on Saturday which says, all Nigerians know and are aware that the mandate does not belong to Tinubu, I will never be surprised if a court declares him victorious.

Falana explained this in an exclusive interview with our correspondent on Saturday.

Recall that the Supreme Court, in a unanimous decision by a five-member panel, dismissed as unfounded an appeal by the opposition People’s Democratic Party (PDP) to challenge Tinubu’s eligibility to run in the February 25 presidential election.

It found that the appeal noted: SC/CV/501/2023, had been lodged in bad faith, and stressed that the PDP, whose candidate Alhaji Atiku Abubakar came second in the presidential campaign, was deprived of legal standing ( legal right), to challenge a nomination by another political party.

The PDP, in its appeal, had asked the court to annul Tinubu’s candidacy, claiming that vice-president-elect Senator Kashim Shettima had voted for more than one ahead of the 2023 general election.

The court was told that Shettima had been nominated twice, both for the Borno central senator seat and for the position of vice president, but when speaking about the development, Falana noted that he was not surprised, since he knows the federal and appellate courts have dismissed the lawsuit, and the legal luminary said the Supreme Court merely upheld the simultaneous judgment of the two courts.

Falana said, Under the current electoral regime, everyone who has been cleared by INEC and received their certificate of return must be sworn in on May 29. That is the law.[img][/img]

This is bear-faced lies. He never said that Nigerians knew that Tinubu did not win. He never said it. Liars!!!

The unanimous decision adopted by the five supreme court judges to dismiss the suit on the mare basis of lacking in 'locus standi', is an indication suggesting that the outcome of the case may have been pre-determined.

I will not be surprised if he comes out to deny making these statements credited to him.

I know that a lot of folks who hate Nigeria are on overdrive to try to discredit this electoral process.

The fact still remains that this election was one of the most free and fair elections in Nigeria.

It was the first time politicians could not just manufacture results anyhow.

It is natural to feel sad that your candidate lost.

The case was not only dismissed by "Locus Standi" or Locust Sitting. The Supreme court also ruled and confirmed that Shettima did not have double nomination.

I don't agree with this. Case in Point was that INEC announced Tinubu winner of a whole state when data showed otherwise. This is ridiculous by all democratic standards and definitely would have turned more developed countries upside-down.

My advice to you is to stop pushing this narrative as it continually offends the sensibilities of voters and only draws ire to the president elect.

The judgement is in order. No court can stop the swearing in. The law is the law whether we like it or not.

The case was not only dismissed by "Locus Standi" or Locust Sitting. The Supreme court also ruled and confirmed that Shettima did not have double nomination.
Bringing locus standi into the judgement automatically means that the argument about the candidacy qualification or validation becomes irrelevant. So it is needles to add whether the jugdement reaffirms the validity status of his candidacy or not. Because the locus standi in the judgement has stripped the petitioners the legality of instituting the case on the ground that it was a foreign body to the defendant and party affairs as it were.
