Please these thread is not for people to who want to start tribal wars, I just want people who are more informed about this to give professional inputs Good morning people of Nigeria

I am somehow puzzled by the words of Wole Olanipekun, the senior lead counsel of Tinubu/APC

He argued that an expired passport means expired citizenship to that country, even tho for you to have been given passport, you must have been a citizen of that country, by birth or naturalization(ways of acquiring citizenship of another country,thru legal means, govt/internal laws, business establishment etc), you must have agreed to the terms, including swearing allegiance to that county, to be loyal and protect the properties and interests of that country, I believe that makes you eternally a citizen of that country except you contravene the laws of the land and you get that citizenship revoked and deported to your home country of origin which was never the case for Mr Tinubu.

I may not be very clear about these things that’s why I am asking these few questions, from those who understands these things more than I do, and also for those who have been defending Olanipekun and asking for proof that Mr Tinubu is a citizen of another country when we could see his international passport of that country, they say since the said passport has expired, that invalidated the citizenship of that country.

They also argued that expired documents is not recognized anywhere, very true., that if NIgerians take expired passport to the banks they won’t be recognized as citizens until they can provide the original etc, they have forgotten that the laws governing Nigeria and politics are slightly different or completely different from laws and requirements for banks. The laws and requirements for the position of the presidency is that you must not have dual citizenship,( pledge allegiance to another country).



My question:
Nigerians who don’t have international
passports, are they not citizens ??

Isn’t being a citizen the first requirement before you are issued an international passport??

Also, can citizenship expired over a period of time, when you have already been given citizenship by another country and you didn’t contravene their laws what ever the case may be??

Hopefully I and others get clearer explanation for these questions

It's very obvious that Olanipekun is talking rubbish.

You're quite right that the first prerequisite towards owning a nation's passport is that one must be a citizen of the country or geopolitical entity issuing the passport.

If you were born to parents from two different nationalities, you can hold two different passports from your parents respective nationalities.

But if you were not born in a country and you don't have a parent who comes from that country, then the only way you can acquire that country's passport is to RENOUNCE the nationality of the country whose citizenship you were born with and swear a citizen oath of allegiance to that country.

I'm very sure Olanipekun is aware of these facts, so his dubious argument is a sign that we're beginning to see just how rotten and perverse the Nigerian judicial system is.

There was a time I wan Japa, na my friend wey dey Dubai say he go help. He say the thing no go cost me pass 900k both ticket and the rest, that was in 2018. Na so rush enter Abeokuta go do international passport. Na that same week I see video where Nigerians and Asians dey battle for job wey Dem say na just 50 vacancies whereas people wey come pass 500k. To cut the story short, I no Japa again grin, I no use the passport again and the passport go expire this September.

I hope say I go still be a Nigerian because I'm not planning to renew it

A passport (also birth certificate, national ID) is just one of the ways to prove citizenship. For example, your atm card (or bank app) only confirms that you have a bank account, it is not the bank account.

The expiry or the loss of your atm card doesn't mean you've loosed your bank account since the atm is declarative in nature. To lose your bank account, you would have to go through an administrative or legal process.

A passport only affirms citizenship (declarative), it doesn't give it (constitutive). To become and renounce your citizenship is a whole legal process, and merely expiration of passport validity is meaningless.

So obviously, this dude is talking shit. If your passport expires, then you must renew it. If you like, don't even renew it, you are still a Nigerian.

And yes, citizenship could be lost in many ways. For countries that do not support dual citizenship, the acquisition of another citizenship will result in the loss of citizenship.

But generally, it is an established principle of international law that countries must do everything possible to prevent statelessness. So you can only be released from your citizenship after getting another one. No UN country will release you as their citizen if you won't show evidence that they've got another one.
