Dismissal Of Appeal: Court Rejects Remi Tinubu’s Request by HighChief4(m): 12:37pm On Oct 20, 2011
Senator Oluremi Tinubu of the Action Congress of Nigeria, ACN, yesterday, lost her bid to have the Court of Appeal sitting in Lagos dismiss the appeal by Labour Party, LP, challenging the judgment of the lower election tribunal which upheld her election for the Lagos Central Senatorial District.

LP had through its counsel prayed the court to set aside the ruling of the tribunal which sat at Igbosere, Lagos.

At the hearing in the appeal, yesterday, Tinubu’s counsel, Mr Olabode Olanipekun, prayed the court to strike out the motion by LP seeking for extension of time to file its brief and compile record of appeal.

Olanipekun argued that the appellant was already out of time, while no explanation had been given to justify granting an extension of time.

LP’s counsel, Chief Chukwuma, SAN, who prayed the court not to dismiss the application in the interest of justice, argued that it was not the position of the Supreme Court and the Court of Appeal to punish applicant based on the sin of counsel.

He said the public holidays and Sundays were not to be counted as part of the time within which the appellant must file its brief.

Justice Helen Ogunwumiju, in her ruling, said although the appellant was out of time in filing its brief, it was the duty of the court to do substantial justice to all election petitions.

The court observed that the 60 days allowed by the Electoral Act to hear appeal arising from the tribunal had not lapsed hence the appellant should not be denied the opportunity to regularise its brief.

Itz no news yet, till they sit on the main electoral matter, but am sure Mrs Remi Tinubu won that election convincingly.

Itz no news yet, till they sit on the main electoral matter, but am sure Mrs Remi Tinubu won that election convincingly.

How could she have won the election proper convincingly when the ACN Congress saw every candidate for the same position step-down for her (Tinubu's orders i am sure)

Remi Tinubu did not win the election.
She got more votes than the PDP candidate only because Dapo Etti who is an ex ACN strong member and also a senatorial candidate for the Labour party wasn't allow to contest.
If Dapo Etti had contested, Remi Tinubu's votes would have been divided into 2, and PDP candidate would have won the election.

Many ACN supporters were pulling for Dapo Etti much more than for Remi Tinubu until they discovered that Dapo's name wasn't listed on the election day, therefore many of these voters just went ahead and voted for Remi Tinubu.
I vividly remember when 1 of the voters confessed that he only voted for Remi Tinubu because Dapo Etti's name was missing.
The old man said "since Dapo's name was missing I voted for Remi because I rather vote for an ACN candidate than voting for a PDP.

I'm not sure if I understand the political strategy you're talking about.
You do not use political strategy to prevent a candidate's name from appearing on the election day; when this is done it is called CHEATING and lack of confidence.
If there was any strategy, Dapo Etti should be given credit for an effective strategy that was put together to make sure that Tinubu's wife didn't win the Eti Osa senatorial election.

Just in case you did not know, Dapo Etti was a very strong and relevant ACN member in Lagos state. He only stepped aside when he discovered that Tinubu was pushing for his wife, Remi (from Ogun state) to go and represent Lagosians as a senator in Abuja. Dapo confronted Tinubu about this decision, but as usual, Ashiwaju was too greedy  to realize his life time mistake. So, Dapo Etti decided to branch out to Labour Party to run against Remi Tinubu.
Dapo Etti's strategy was not to win, but to ensure that ACN votes were divided into 2 parts, this way the PDP senatorial candidate would have had a better chance to win the election.
